General information about the formation Databases of non-governmental organizations
In Kazakhstan, as part of the adopted amendments to the legislation in the field of NGO activities, a database of non-governmental organizations was created at the end of 2015.
For reference: amendments to the Law of the Republic of Kazakhstan "On state social Contracting, grants and awards for non-governmental organizations", dated 12 April 2005 (hereinafter – the Law) introduced by the Law of RK "On amendments and additions to some legislative acts of the Republic of Kazakhstan on the activities of non-governmental organizations" of December 2, 2015 http://10.61.43.123/rus/docs/Z050000036_
Starting in 2016, Kazakhstan's NGOs and branch offices of foreign and international NGOs sent information on their activities to the authorized body (Ministry of religious Affairs and civil society) each year by 31 March in accordance with paragraph 5 of article 41 of the Law "On noncommercial organizations". The rules for providing information about their activities by non-governmental organizations and creating a Database about them (hereinafter referred to as the rules) were approved by Order of the Minister of Culture and Sports No. 51 of February 19, 2016 (http://10.61.43.123/rus/docs/V1600013355).
For reference: In accordance with paragraph 5 of article 41 of the Law "On nonprofit organizations", nonprofit organization created in the form of an institution, public Association, joint-stock companies, foundations, unions of legal entities in the form of an Association (Union), and in other forms not provided for by article 17 of this Law, branches and representative offices (separate subdivisions) of foreign and international commercial organizations, performing activity on the territory of the Republic of Kazakhstan, annually until March 31, they submit to the authorized body in the field of interaction with non-governmental organizations information about their activities, including their founders (participants), the composition of property, sources of formation and directions of spending money in the manner approved by the authorized body in the field of interaction with non-governmental organizations.
According to the rules, information is provided by non-governmental organizations in Kazakh and Russian languages by filling out a Form that is an annex to the Rules approved by Order No. 51, through mail or on purpose on paper and electronic media (CD-disks or USB-flash drives in Word format) annually until March 31 of the year following the reporting period:
- until March 31, 2017 via mail or on purpose on paper and electronic media (CD-disks, or USB-flash drives in Word format).
- From March 1, 2017, NGOs will also be able to provide information through the Internet portal of the NGO Database http://infonpo.kz. Authorization on the Internet portal is possible with the help of an EDS key obtained from the PSC.

Thus, the reporting information is presented in two versions of the completed table – one in Kazakh, the second in Russian.
In total, the Form has 3 sections: General data, Data on activities and Data on the composition of property, sources of formation and directions of spending money.
For reference: Methodological recommendations for filling out the Reporting Form in the NGO Database have been developed for the Rules, as well as answers to frequently asked questions on providing information to the NGO Database. These documents can be found on the website of the Ministry of Religious Affairs and Civil Society at http://www.din.gov.kz/rus/baza_npo.
When filling out the Form to the head of non-governmental organizations will need a range of documents, including: articles of organization and incorporation documents, passport and contact details of the head of the organization, information about the registration of branches and representative offices of the company (if any), certificate of state registration of a legal entity, the approved project application, agreements on implementation of state social order, grant agreement, etc., existing during the reporting period – during 2016, the balance sheet for 2016, as well as title documents for movable and immovable property (if available).
It should be noted that the reporting period is understood as the calendar year preceding the year of providing information to the Database. Thus, the reporting period as of March 2017 is
the 2016 calendar year. In the relevant section, NGOs provide information only on those projects that were completed before December 31, 2016.
Important: the presence of a non-governmental organization in the NGO Database gives an advantage when evaluating technical specifications submitted by potential suppliers in the framework of the state social order competition in accordance with the Order of the Minister of Finance of the Republic of Kazakhstan dated December 11, 2015 No. 648 "On Approval of the Rules for Public Procurement", as well as when allocating grants for NGOs in accordance with the order of the Minister of Culture and Sports of the Republic of Kazakhstan dated December 25, 2015. no. 413 " on approval of the rules for granting grants to non-governmental organizations and monitoring their implementation»
To date, the Internet portal "NGO Database"has been developed. the portal is currently running in test mode. it is expected that after the introduction of the internet portal into public use, ngos will annually update information about their activities according to the form in the personal accounts of users.

The responsible unit for the formation of a Database of NGOs in the structure of the Committee on civil society of the Ministry of religious Affairs and civil society of the Republic of Kazakhstan is Management of inter-Ministerial coordination Committee for civil society MARGO RK.
Administrative responsibility:
Code of RK "On administrative offences" provides for administrative liability for failure to submit, untimely submission or submission of unreliable or false information in the Database (article 489-1: item 1 – warning; item 2 – for repeated violation - a fine of twenty-five monthly calculation indices or suspension of activities for a period of three months).
