Who can act as a representative of the minor

In the presence of legal representative, it is assumed that the minor could stay in the entertainment establishment later than the specified time.

Other adults cannot be recognized as legal representatives.

Finding the minor in the entertainment establishment in the presence of other adults (for example, with a fellow, with a company of fellows), but without legal representatives, will be illegal.

For a juvenile delinquent who helped a neighbor to fill the skating rink after 11 pm, and who was occasionally outside the home, the neighbor is not a legal representative.

Only legal representatives have the right to pick up a child from the police.

If the parents are temporarily out of the city, then the relatives or representatives must present an appropriate document or a notarized power of attorney.

What is the responsibility of legal representatives, owners of the establishments

The fine imposed on parents, legal representatives for their minors being unaccompanied is as follows:

  • for the child staying in the entertainment establishments from 10 pm to 6 am - the fine is 3 MCI;
  • staying outside the home from 11 pm to 6 am  is followed by a first warning.

If a similar fact repeats within a year, a fine of 7 MCI is provided.

For finding a child at the wrong time, the owners of the entertainment establishment will also be fined.

The amount of the fine depends on the status of the offender, as well as on whether the offender was previously involved in such a violation within a year. The fine can be applied together with the suspension of the establishment activities or certain types of activities.

The size of the fine is:

  • for individuals - 10 MCI, in case of a repeated offense - 20 MCI;
  • for small businesses or non-profit organizations - 15 MCI, if repeated - 30 MCI;
  • for medium-sized businesses - 30 MCI, if repeated - 50 MCI;
  • for large business entities - 50 MCI, if repeated - 100 MCI.

The hours the child is not allowed to stay in the entertainment establishments and outside the home

From 10 PM to 6 AM the child is not allowed to visit or be admitted in the entertainment establishments unaccompanied by the legal representative. The entertainment establishments are referred to the following:

  • gambling establishments,
  • night clubs,
  • cafe-bars,
  • restaurants,
  • Internet cafe,
  • Computer cafes,
  • billiard rooms,
  • bowling clubs and cinemas,
  • facilities for theatrical and entertainment purposes and other buildings,
  • premises, facilities wherein the entertainment and leisure, theater and entertainment, sports, cultural and leisure services are rendered.

From 11 pm to 6 am the minors are not allowed to stay on the street without being accompanied by the legal representative.

In cases when at this time children are sitting on a bench in the yard near the house, go out to take out the garbage at a late hour, go to the store, which is located 5 meters from the house where he lives, the police are obliged to find out the reason for his presence, establish legal representatives, in the absence of the possibility of their timely establishment, provide delivery the minor is referred to the police body for taking further measures to establish his legal representatives.
