Legalization of Documents and Affixing of the Apostille Stamp

How to find out if consular legalization or an apostille is required?
If the country where the document is intended to be used is a party to the Hague Convention of 1961, then an "apostille" stamp is required. Otherwise, consular legalization is needed.

In any case, the most crucial source of reliable information is the organization to which the legalized document must be submitted, as sometimes different authorities within the same state have different requirements for the legalization of foreign documents. Therefore, you must clarify the requirements for the type of legalization with the body to which you intend to submit the legalized document.

The affixing of an "apostille" stamp is used for sending a document to countries that have acceded to the Hague Convention of October 5, 1961, which abolishes the requirement of consular legalization and introduces a simplified legalization procedure — the affixing of an "apostille" stamp.

This procedure is called simplified precisely because, on one hand, apostilling is carried out fairly quickly and by only one authorized body, and on the other hand, the document acquires legal validity in the territory of all countries that have acceded to the Hague Convention.

If the country for which you are preparing the document is not a party to the Hague Convention, consular legalization is required. This is a more complex procedure, which involves the certification of the document by the bodies of the Ministry of Foreign Affairs of the Republic of Kazakhstan, the foreign embassy in the Republic of Kazakhstan, and then by the Ministry of Foreign Affairs of the destination country. In this case, the document will have legal force only within the territory of the country whose consular mark is affixed to it.
