Approximately a Thousand Appeals: Outcomes of the Constitutional Court's Work in the First Quarter of 2024

During the first quarter of 2024, the Constitutional Court received approximately a thousand appeals from citizens. These appeals mainly centered around disagreements with judicial rulings and complaints regarding the actions and inactions of law enforcement agencies, state bodies, and courts of general jurisdiction – areas beyond the scope of the constitutional review body.

Additionally, applicants raised concerns related to housing and labour relations, social protection, access to information, interpretation of Basic Law provisions, clarification of legislative norms, and more. Only 29 percent of the applications requested a review of the constitutionality of laws and other normative legal acts.

Presently, the Office of the Constitutional Court is in the process of preliminary consideration of 135 appeals from citizens. 952 applications that did not meet the admissibility requirements have been returned to citizens, accompanied by explanations for the return and guidance on their right to reapply.

The Constitutional Court has examined the constitutionality of certain provisions of criminal, civil procedure, tax legislation, the Marriage (Matrimony) and Family Code, the Road Traffic Act, the Compulsory Civil Liability Insurance for Owners of Motor Vehicles Act and the order of the Minister of Justice on the list of types of income for withholding alimony in 13 constitutional proceedings (https://www.gov.kz/memleket/entities/ksrk/press/article/details/129461?lang=ru).

One proceeding concerning the verification of certain norms of the Code of Administrative Procedure concluded with the issuance of a final decision. In this decision, the Constitutional Court highlighted uncertainties in the procedure for appealing against measures of procedural coercion in administrative proceedings (https://www.gov.kz/memleket/entities/ksrk/documents/details/582386?lang=ru).

The majority of appeals to the Constitutional Court regarding the constitutionality of laws and other normative legal acts originated from residents of Astana, Almaty, Karaganda, and Akmola regions.
