What purposes can I use my pension savings for?

Pension payments can be used for:

  1. Repayment of mortgage loan debt, including within the framework of financing by the Islamic bank (partial or full);
  2. Purchase of housing without a mortgage (full purchase);
  3. Obtaining a mortgage housing loan under the system of housing construction savings in " Otbasy Bank»;
  4. Making a down payment for obtaining a mortgage loan (including in the framework of financing by an Islamic bank);
  5. Repayment of debt under the lease agreement with the right to purchase;
  6. Construction of an individual residential building (including the purchase of a land plot);
  7. Refinancing of a residential mortgage loan;
  8. Treatment.

Repayment of mortgage debt, including within the framework of financing by the Islamic bank (partial or full)

You can partially or completely repay the debt on the loan for the purchase of housing, housing with repairs under a single bank loan agreement, received from any bank or mortgage company. Also, you can repay the loan received under the system of housing construction savings, issued for the construction of an individual residential building, including the purchase of a land plot with the intended purpose of residential housing or LPH.

Required list of documents to confirm the goal:

  • certificate of availability and balance of loan debt. The certificate is valid for 15 working days from the date of issue

The help must contain:

  • name of the bank or the name of the bank's branch
  • full name, iin of the borrower
  • details of the bank loan agreement
  • purpose of the loan issued under the agreement
  • purpose of the EPO: partial or full repayment of debt on a mortgage housing loan for the purchase of
  • housing and (or) housing with repairs under one bank loan agreement
  • balance of loan debt
  • Full name, position and signature of the authorized person
  • of the bank bank loan agreement (if there is no information about the purpose of the mortgage loan in the certificate)

Purchase of housing without a mortgage (full purchase)

You can buy an apartment, an individual residential building, a room in a hostel. Housing can be purchased on the primary or secondary market, as well as in a house under construction by equity participation in housing construction with a guarantee in accordance with the legislation of the Republic of Kazakhstan, privatization, installments, exchange, an agreement on the transfer of a share in an apartment building in accordance with the legislation on equity participation of the Republic of Kazakhstan.

Housing for this purpose can be purchased at the expense of pension savings and at the expense of pension and own funds.

Required list of documents to confirm the goal:

  • the contract of purchase and sale of housing, privatization, barter, and other title documents confirming the right of ownership of the housing, registered by the authorized body, issued in the name of the recipient;
  • the document of the authorized body on the registered rights (encumbrances) on real estate and its
  • technical characteristics (except for cases of acquisition of housing by equity participation in the housing construction of an apartment building)

In the case of the acquisition of housing by equity participation in the housing construction of an apartment building:

  • registered by the authorized body agreement on equity participation in housing construction/cession agreement, issued in the name of the recipient with the annex of the agreement on equity participation in housing construction, issued in the name of the former shareholder (including in electronic form);
  • statement of the account of the agreement on equity participation in housing construction/assignment agreement, (including in electronic form);
  • certificate / letter from the developer on the existence of a signed contract for the provision of a guarantee for the completion of the construction of an apartment building with JSC " Kazakhstan Housing Company "(Unified Housing Construction Operator);

In case of full repayment of the debt under the installment agreement:

  • registered installment agreement with repayment schedule (if there is a schedule);
    document of the authorized body on registered rights (encumbrances) to immovable property and its technical characteristics;
  • certificate/letter from the seller (individual, legal entity) the amount of the debt under the installment agreement, the bank details of the account to which the EPO must be transferred to repay the debt under the installment agreement.

How to find out the available amount of pension savings

The available amount is the amount of pension savings formed by mandatory pension contributions (MPC), which can be used for lump-sum pension payments (LPP) for the purpose of improving housing conditions or paying for treatment in the manner established by the Social Code of the Republic of Kazakhstan

LPPs are made if one of the following conditions is met:

- if the amount of pension savings from MPCs available in the individual pension account of the MPC contributor exceeds the minimum sufficiency threshold of pension savings determined in accordance with the methodology approved by the Government of the Republic of Kazakhstan. In this case, the LPP cannot exceed the difference between the amount of pension savings from the recipient's MPCs, which are in the trust management of the National Bank of the Republic of Kazakhstan, and the minimum sufficiency threshold* of pension savings; 

* the threshold of minimum sufficiency of pension savings is the minimum amount of pension savings formed through mandatory pension contributions, necessary to ensure a monthly pension not lower than the minimum pension established by the law on the republican budget and effective as of January 1 of the relevant financial year, determined in accordance with the methodology approved by the Government of the Republic of Kazakhstan

- if the pension amount for persons specified in paragraphs 1-3 of Article 207 of the Social Code, as well as the amount of monthly maintenance for retired judges, ensures the average monthly income replacement rate (AMIR) of the recipient at a level of not less than 40 percent, determined in the manner determined by the Government of the Republic of Kazakhstan, while the AMR cannot exceed 50 percent of the amount of pension savings at the expense of the recipient's OPV, which are in trust management of the National Bank of the Republic of Kazakhstan. The AMIR is calculated in accordance with the Methodology approved by the Government of the Republic of Kazakhstan, including on the basis of data obtained from the information systems of state bodies;

- if the OPV contributor has entered into a pension annuity agreement with an insurance organization, while the EPV may not exceed the amount of pension savings at the expense of the recipient's OPV, which are in trust management of the National Bank of the Republic of Kazakhstan;

- if the contributor is a recipient of pension payments for length of service, while the EPV may not exceed the amount of pension savings at the expense of the recipient's OPV, which are in trust management of the National Bank of the Republic of Kazakhstan.

Before exercising the right to use part of the pension savings, the OPV contributor (recipient of pension payments) must check his pension savings and make sure that there is an amount of pension savings available for withdrawal for the purpose of improving housing conditions and paying for treatment.

Replenishment of the contribution to housing construction savings for further accumulation

Pension savings of Kazakhstanis above the sufficiency threshold can be used for housing deposits. To transfer your savings to Otbasy Bank, you need to use the platform www.enpf-otbasy.kz .

It is also necessary to open a housing deposit and a special account in Otbasy Bank in advance, which can be issued online. Kazakhstanis should also check their retirement account for sufficient savings.

On the website www.enpf-otbasy .kz there is a button "Replenishment of the contribution to housing construction savings for further accumulation" Kazakhstanis will need to log in using EDS.

Next, you need to check the availability of a deposit, a special account in your personal account. You will have to open them if it was not done in advance.

After that, an application will be generated on the platform and sent to the UAPF for the transfer of pension surpluses. The review period will be 5 working days. Then the money will be transferred to a special account of Kazakhstanis in Otbasy Bank, after which it will be automatically transferred to a housing deposit.

These funds will be subject to the same remuneration rules as for ordinary housing savings, a bank remuneration of 2% per annum and a state bonus of 20% will be accrued (for the amount of savings for the year, which does not exceed 200 MCI).

As a result, Kazakhstanis will be able to:

- to replenish the contribution to housing construction savings for further accumulation in order to purchase real estate. A mortgage must be issued within three years; purchase a land plot for the construction of an individual house or build an individual residential house on your land plot.

If the bank's clients do not use the pension surpluses within the specified period, the funds will be returned to the UAPF.

If depositors have already applied for the withdrawal of part of pension savings, they will be able to change the purpose of withdrawal. However, the time for confirming the purpose of use has been reduced to 20 working days.

For example, there are pension surpluses, but now their amount is insufficient for mortgage registration. At the same time, an application for their withdrawal has already been submitted. In this case, Kazakhstanis will be able to safely transfer these funds to their account in Otbasy Bank in order to purchase housing together with other savings.

It should be remembered that money from the UAPF cannot be:

  • withdraw from the housing deposit. And if you close the deposit, they will be transferred back to the pension fund;
  • give them and their contribution to their loved ones: otherwise, the surplus will also be returned to the UAPF;
  • withdraw and cash out when dividing the deposit: you can withdraw only your own savings and the bank's remuneration, the state's premium; sell together with the deposit;
  • use this deposit as a third-party guarantor deposit.

Repayment of debt under the lease agreement with the right to purchase

If you have entered into a lease agreement with the right to buy out under housing construction and anti-crisis programs, you will be able to use your pension savings to partially or fully pay the debt under long-term housing lease agreements.

Required list of documents to confirm the goal:

  • lease agreement with the right to buy (with the schedule of repayment of lease payments attached), concluded within the framework of housing construction and anti-crisis programs;
  • a letter signed by an authorized person of the organization about the details and amount of the debt under the lease agreement with the right to buy out, about the bank details of the account to which it is necessary to transfer one-time pension payments to repay the lease debt.

Obtaining a housing mortgage loan under the system of housing construction savings in Otbasy Bank

You can buy an apartment, an individual residential building, a room in a hostel. Housing can be purchased on the primary or secondary market. Also, within the framework of a single bank loan agreement, you can purchase housing with repairs, build an individual residential building (including the purchase of a land plot with the intended purpose of residential housing or LPH)

After submitting an application for this purpose, the bank's employees will contact you and conduct a full consultation on the procedure and the necessary documents.

Use of pension savings for medical treatment

At the moment, it is possible to apply for treatment only in Kazakhstan. Acceptance of applications for medical services abroad will be available later.

How to apply for the use of pension savings for treatment:

  1. Apply for a one-time pension payment and sign the EDS;
  2. UAPF will transfer the EPO amount to your special account in Otbasy Bank within 5 working days;
  3. After receiving funds for a special account, contact a specialized medical specialist for a diagnosis;
  4. After receiving the conclusion of a specialized specialist, contact the medical organization at the place of attachment (you can find out the place of attachment on the portal gov.kz) and submit there an application for the conclusion of the medical commission, with a copy of the identity document attached;
  5. The medical commission within 5 working days from the date of the request will make a decision either on the referral for treatment, or on refusal;
  6. Within 2 working days, the secretary of the commission will issue you an opinion;
  7. After receiving a positive conclusion, select the medical organization in which you want to be treated, and enter into a contract with it. The contract must specify the license for this type of activity, the type of medical services, the established diagnosis from the conclusion of the medical commission and the details of the medical organization;
  8. Upload to the enpf-otbasy platform.kz the conclusion of the medical commission and the contract with the medical organization in PDF format;
  9. Otbasy The bank will check the compliance of the documents within 5 working days and transfer the funds from your special account to the medical organization according to the details specified in the contract.

Procedure for early use of pension savings

All operations on early use of pension savings are carried out online and for this you will need a valid electronic digital signature.

First, the depositor needs to obtain information about the available amount of a lump sum pension payment on the Internet resources of the UNPF or e-government. Then, using the EDS, you need to register on the website of one of the authorized operators and open a special account.

Today, the authorized operators accepting applications for lump sum pension payments are:

  • for improving housing conditions are JSC Housing Construction Savings Bank Otbasy Bank, JSC Halyk Bank of Kazakhstan, JSC Altyn Bank, JSC Bank CenterCredit, JSC Freedom Bank Kazakhstan;
  • for paying for treatment - JSC Housing Construction Savings Bank Otbasy Bank.

The authorized operator within 2 working days after reviewing the application for lump sum pension payments sends an electronic notification to the UNPF. The UNPF, within five working days from the date of receipt of the electronic notification from the authorized operator, transfers the lump sum pension payment of the recipient to the authorized operator in the absence of grounds for refusal to pay.

After the funds have been received in the special account, the applicant or his legal representative must provide the authorized operator with documents confirming the intended purpose of the lump sum pension payments for the following purposes:

  • improving housing conditions - within 20 working days;
  • paying for treatment - within 45 working days.

The authorized operator checks the documents provided by the applicant within 10 working days from the date of their submission and, if there are no comments, transfers the lump sum pension payments for their intended purpose.

It is permitted to use lump sum pension payments in favor of the recipient or the spouse of the recipient, or close relatives of the recipient. Close relatives are parents (parent), children, adoptive parents (adopters), adopted children (adopted), full and half siblings, grandfather, grandmother, grandchildren.

The presence of housing in the recipient's ownership is not a reason for refusing to receive and use lump-sum pension payments. Lump-sum pension payments can be used an unlimited number of times.

Assignment of pension savings to a relative

IMPORTANT! The receiving party must be authorized on the platform before you choose this goal, for the correct formation of a bilateral agreement.

You can use the pension savings of your spouse or close relatives (with their consent) for any of the above purposes. Close relatives are parents, children, adoptive parents, adopted children, full / half siblings, grandparents

Instructions for conceding pension savings:

  1. To assign funds to a close relative, you need to select the goal "Assignment of funds to a close relative", specify the amount you want to assign, as well as the IIN of the person in whose favor the pension savings are being assigned;
  2. Next, you need to form the necessary statements, sign a bilateral agreement on the assignment of one-time pension payments to your EDS;
  3. Wait for the message " Good news! Your single pension payment has been credited to your special account!". This will take up to 5 business days. This message means that the receiving party can go to the platform and choose any goal for improving housing conditions and / or paying for treatment;
  4. Then, you need to upload documents confirming a close relationship or marriage with the host party.

Construction of an individual residential building (including the purchase of a land plot)

You can build an individual residential building (including purchase a land plot with the intended purpose of individual housing and communal services) at the expense of pension savings, at the expense of pension savings and your own funds.

Required list of documents for receiving funds:

For the purchase of a land plot:

  • the contract of purchase and sale of the land plot, barter, other title documents, registered by the authorized body, confirming the right of ownership/the right of land use for the land plot with the intended purpose-individual housing construction or personal subsidiary farm, issued in the name of the recipient;
  • an act on the right of private ownership of a land plot, an act on the right of temporary paid land use (lease);
  • the document of the authorized body on the registered rights (encumbrances) on real estate and its technical characteristics (on the land plot);

For the construction of a house:

  • architectural and planning task (APZ);
  • a contract signed with a construction company that has the appropriate license (providing for the complete completion of the construction of an individual residential building). In cases where the recipient has already paid part of the amount for the construction at their own expense, it is necessary to provide an additional agreement to the contract agreement, which records the fact of partial payment at the expense
  • of the recipient's own funds;
  • construction company license for construction and installation works;
  • construction and installation works;
  • cost estimate for construction and installation works, drawn up by the recipient/construction company (providing for the complete completion of the construction of an individual residential building)
    draft design, agreed with the territorial authority of architecture and urban planning;
  • notification of the start of construction (only for individual residential buildings of more than 2 floors).

The deadline for confirming the goal is 24 months from the date of receipt of funds to the contractor's account.
