CENTRAL GOVERNMENT AGENCIES ARE NOT SUBJECT TO COMPETITION LAW

The agency for the protection and development of competition continues to work to suppress anti-competitive actions on the part of government agencies that have led or may have led to the restriction or elimination of competition.

Despite the obligation of state bodies to take measures to develop competition in the implementation of state policy in the relevant sectors of the economy and not to take actions (omissions) that negatively affect competition, some of them continue to ignore the norms of the business code.

CDIAP, in turn, limited access to the digital documents service for new projects by establishing a requirement for the presence of at least 100,000 users in the rules for the integration of informatization facilities. In this regard, the agency issued a ruling on the abolition of this norm, which was successfully implemented.

At the same time, an investigation has been completed on the fact of restricting competition in relation to the MFM and giving preference to a particular market entity by refusing to include subsurface plots in the PUGFN and not holding auctions with a high amount of signing bonuses.

In total, 71 reports on signs of anti-competition were issued in 2023, and 21 investigations were completed.

Last year, the antimonopoly authority checked the activities of the ministries of finance, health, industry and construction among central state bodies.
