Last year, the courts considered 180 cases related to violation of competitive rights and entered into legal force. This implies the active participation of the country's judicial system in antitrust actions. This was stated by the chairman of the agency for protection and development of competition Marat Omarov.
Among them, 84 administrative cases and 92 administrative proceedings, as well as 4 cases that demonstrate the importance of the law enforcement approach in civil proceedings, stand out.
In addition, the agency has succeeded in 47 cases, accounting for 56% of administrative cases, an indicator of an improved strategy for collecting evidence and representing it in court. Within the framework of administrative proceedings, penalties were imposed in 82 cases.
It was made possible by close relations with the Supreme Court and analysis of antitrust practices, and also contributed to improving the quality of the agency's work. Important changes in legislation and practice, such as the need to analyze the competitive environment when proving antimonopoly agreements, were carried out thanks to this cooperation, M. Omarov said.
Systemic shortcomings and key approaches to improving investigative procedures were also identified, which was an important step towards maintaining fair regulation and competition.
