THE RAILWAY COMPANY PAID A FINE FOR VIOLATING ANTITRUST LAWS

The Department of the Agency for the Protection and Development of Competition in the Atyrau Region of the Republic of Kazakhstan (hereinafter - the Department) with the Atyrau Transport Prosecutor's Office (hereinafter - the Prosecutor's Office) conducted an audit of Batys Trans Group LLP. During this audit, the fact of violation of legislation in the field of competition protection was revealed in terms of abuse of monopoly position in setting, maintaining monopolistically high prices and applying different prices or different conditions to equivalent agreements.

According to the Prosecutor's Office, the Department initiated cases of administrative offenses against Batys Trans Group LLP under parts 3 and 3-1 of Article 159 of the Code of the Republic of Kazakhstan "On Administrative Offenses".

Following the consideration of the case, by the decision of the Specialized Court for Administrative Offenses of Atyrau, Batys Trans Group LLP was brought to administrative responsibility for committing an administrative offense and a fine of more than 23 million tenge was imposed with confiscation of monopoly income received as a result of monopolistic activities in the amount of more than 52 million tenge, which was paid in favor of the state in full.
