In connection with the incoming appeals from citizens and the media, the Agency for the Protection and Development of Competition informs about the following procedure for compensation of losses to consumers in antitrust cases.
On the basis of court decisions that have entered into force on bringing a market entity to administrative responsibility for violating antimonopoly legislation, consumers have the right to independently apply to the court with a claim for compensation for losses caused by such a violation.
Information on the revealed facts of violations of antimonopoly legislation is regularly posted on the Agency's website in the Press Center section https://www.gov.kz/memleket/entities/zk/press?lang=ru .
The decisions of the courts, from which it should be determined in which cases damages are reimbursed to consumers, can be found on the website of the judicial cabinet https://office.sud.kz/index.xhtml .
In case of uniformity of the subject matter of the dispute and the claims, the court, in accordance with article 33 of the Code of Civil Procedure, may combine the consideration of several claims within the framework of one judicial proceeding.
At the same time, in order to improve the mechanism of compensation for damages caused to a large number of people, the antimonopoly authority has developed a bill providing for the introduction of the institution of collective claims.
The draft law is being publicly discussed and posted on the portal of open regulatory legal acts at the link: https://legalacts.egov.kz/arm/admin/viewcard?id=14827026 .
