PUBLIC DISCUSSION OF THE RESULTS OF THE REGULATORY IMPACT ANALYSIS ON COMPETITION ISSUES

As part of the amendments to the business code of the Republic of Kazakhstan, the agency for the protection and development of competition of the Republic of Kazakhstan (hereinafter referred to as the agency) conducted an analysis of the regulatory impact.

          The forecast changes will affect the following issues in the electric power industry and coal regulation:

1) a ban on the presence of persons in the same group in accordance with the legislation of the Republic of Kazakhstan with an energy transmission organization for energy supply organizations;

2) Prohibition of the sale (sale) of municipal coal to market entities that do not have railway dead ends equipped with weighing devices and loading and unloading devices and have infrastructure for storing coal on the right of ownership or other legal grounds;

3) Prohibition of the sale (resale) of municipal coal among market entities operating in the same commodity market.

          In this regard, the agency informs that in accordance with paragraph 20 of the "rules for the analysis and use of regulatory impact of regulatory instruments and (or) requirements", approved by the order of the Minister of national economy of the Republic of Kazakhstan dated November 30, 2015 No. 748, a public discussion on the above issues will be held on December 25, 2023 at 16.00.
