APDC SENT PROPOSALS TO THE MINISTRY OF HEALTH OF THE REPUBLIC OF KAZAKHSTAN

The agency for protection and development of competition of the Republic of Kazakhstan has completed an analysis of the state of competition in the market of services for professional examination of medicines and medical devices for the formulary Commission.

During the analysis, it was found that the Ministry of health of the Republic of Kazakhstan by its legal act granted the RSE on PCV "National Scientific Center for health development named after Salidat Kairbekova" (hereinafter referred to as the Center) an exclusive right to conduct a professional examination of medicines and medical devices for the formulary Commission. It also became known that for the formulary commission, it will take a 100% share of dominance in the market of services for the examination of medicines and medical devices.

Also, according to representatives of the pharmacological business, there are administrative barriers to the delay in the terms of consideration of applications by the formulary Commission, the sequential inclusion of medicines (hereinafter - DZ) in the lists of the Kazakhstan national formulary (hereinafter – NF), outpatient drug support (hereinafter – ADF) and the single distributor of SK-pharmacy (hereinafter – BD), which leads to restrictions on the patient's access to innovative drugs. Also, questions arise about the objectivity of the formation of prices for professional expert services.

Based on the results of the analysis, recommendations were sent to the Ministry of health of the Republic of Kazakhstan on taking the following measures:

Revision of the pricing policy of the Center in order to reduce the cost of services;
Regulation of the terms of consideration and meetings of the formulary Commission;
Regulation of the timing of acceptance and publication of the minutes of the formulary Commission with the possibility of online broadcasting and (or) face-to-face participation of applicants;
Integration of regulatory legal acts of the Ministry of health of the Republic of Kazakhstan on the introduction of medicines into the Kazakhstan national formulary, regulatory legal acts on the concomitant introduction of medicines into the KNF, lists of ads, MD with the possibility of submission of ads and MD to a single regulatory legal act in the form of a single document;
Put into operation the information system of the center with subsequent integration into the information system of the National Center for expertise of medicines and medical devices, ensuring full digitalization and automation of all processes and services on the principle of "one window" for DZ in the format of public services.

Part of the recommendation is provided for by the draft law on the development of competition.
