The Department of anti – corruption (Anti-Corruption service) in Astana within the framework of the project "road to Business" JSC "Kaztransgazaymak" (hereinafter referred to as "kaztransgazaymak") – Joint-Stock Company) in close cooperation with the agency for protection and development of competition (hereinafter-WKDA) within the framework of the application of the Association of entrepreneurs "Birlik Gaz" regarding unjustified interference in the competitive environment, analyzed the state of competition in the market of construction and installation works (KMF) and the presence of a state-owned company in the KMF market when connecting consumers to natural gas (intra-House Gas Networks), and found that it is inappropriate.
In 2019-2023, more than 6.3 thousand settlements were connected to gas, and more than 11.6 thousand consumers received access to blue fuel. This, of course, increased the high demand for KMF services.
When analyzing and comparing the cost of kmz contractors and independent kmz suppliers of a joint-stock company, it was shown that prices are in the same range and (in some regions, the cost of services of contractors of a Joint-Stock Company is higher than similar services of private companies) and have little effect on the rate of gasification.
Therefore, the price offered by the Joint-Stock Company cannot be an indicator of prices in this market with developed competition due to the presence of more affordable offers on the KMZ market without it.
Thus, the market is competitive, with a share of more than 800 entrepreneurs. There are 141 entrepreneurs in Astana alone.
Thus, the Joint-Stock Company, having a dominant position, entered into a contract with one of the LLP'S subsidiaries for KMF, so entrepreneurs had to work as subcontractors.
Also, in order to accelerate the pace of gasification without direct state intervention, the APDC sent proposals to the relevant state bodies.
On the basis of the above, on June 22 this year, the APDC issued a decree to the Joint-Stock Company on the need to stop the implementation of these works on the KMZ market, including through the purchase of these works from third-party organizations.
The order was given 15 calendar days to execute.
