KAZAKHTELECOM JSC FULFILLED THE REQUIREMENTS OF THE ANTIMONOPOLY AUTHORITY

The Department of the agency for protection and development of competition of the Republic of Kazakhstan for Astana, during the inspection of the activities of Kazakhtelecom JSC (hereinafter – Joint-Stock Company) on the rental of ONT devices for internet access under the "iD Net" service, found that there are signs of rental of additional equipment (modem) to subscribers (necessarily).

According to the information of the Joint-Stock Company, between Olt stationary equipment of the G-PON network and client equipment that is necessarily leased to subscribers by the Joint-Stock Company, each manufacturer uses its own (copyrighted) protocol of interaction OMCI. Thus, the client, having the same equipment as the stationary manufacturer, will not be able to use it, since the Joint-Stock Company "necessarily leases"its equipment to the subscriber.

These actions of the Joint-Stock Company violated the norms established by the rules for the provision of communication services No. 171 dated 24.02.2015 regarding the client's right to use its certified subscriber devices to receive internet access services.

Consequently, in the actions of the Joint-Stock Company, the Department noticed signs of violation of legislation in the field of competition protection, in particular, actions of abuse of the dominant position, which infringes on the legal rights of consumers.

In this regard, a notice was sent to the Joint-Stock Company on the need to take measures to eliminate signs of violations, including a note to provide consumers with the opportunity to use their equipment.

The notice of the Joint-Stock Company was executed. Thus, relevant information about the possibility of using its own equipment was posted on the website of the Joint-Stock Company https://telecom.kz/kk/common/client-equip.
