PUBLIC SERVANTS ARE BROUGHT TO JUSTICE

The Department of the Agency for the Protection and Development of Competition of the Republic of Kazakhstan in the Almaty region (Department), together with Taldykorgan Prosecutor's office have analyzed the legality of contracts concluded in the field of public procurement.

As a result of the analysis, it was turned out that State facilities the Department of Housing and Communal Services of Taldykorgan City" and the  Department of Passenger Transport and Highways of Taldykorgan City illegally concluded agreements with Taldykorgan Korkeytu LLP (Partnership).

In particular, state bodies have concluded agreements with the Partnership for public procurement of works on sanitary cleaning, summer cleaning and washing of streets, maintenance of stop complexes, maintenance of parks and squares.

However, the rights of the Partnership, which is a legal entity with 100% state participation, are limited in the performance of the work specified in the contract, since these activities do not correspond to the list of activities carried out by legal entities, more than fifty percent of shares (shares of participation in the authorized capital) which belong to the state, and persons affiliated with them, approved by the Resolution of the Government of the Republic of Kazakhstan.

As a result of the conclusion of agreements with the Partnership, government agencies have limited fair competition among private entrepreneurs.

On the basis of the revealed facts and the requirement of the Taldykorgan city Prosecutor's office, the Antimonopoly Department for the Almaty region in relation to the Department of Housing and Communal Services and the Department of Passenger Transport and Highways of Taldykorgan issued an order to terminate contracts, officials of state institutions were brought to administrative responsibility.
