Standard rules of organization and procedure for the election of the Board of Trustees in educational organizations
Chapter 1. General rules
1. Model regulations the organization of the work of the Board of Trustees in educational institutions and the procedure for the election (hereinafter-regulations) developed in accordance with paragraph 9 of article 44 of the Law of the Republic of Kazakhstan dated 27 July 2007" On education " and determine the organization of work of the Board of Trustees of the educational organization and his election.
2. The Board of Trustees created in military, special, medical and pharmaceutical educational institutions, non-state educational institutions under the jurisdiction of the national security bodies of the Republic of Kazakhstan, the Ministry of internal Affairs of the Republic of Kazakhstan, bodies of Prosecutor's office of the Republic of Kazakhstan, the Ministry of defence of the Republic of Kazakhstan and the Ministry of health of the Republic of Kazakhstan, as well as in educational institutions, excluding public non-profit educational organizations established in the form of joint-stock companies.
3. the Board of Trustees interacts with the administration of the educational organization, the parent Committee, local Executive bodies, interested state bodies and other individuals and/or legal entities.
4. members of the Board of Trustees shall Exercise their powers free of charge.
Chapter 2. General provisions election Procedure and composition of the Board of Trustees
5. the Authorized body of the relevant industry or local Executive body in the field of education shall place on its Internet resource and/or in a periodical published on the territory of the administrative-territorial unit an announcement on the creation of the Board of Trustees and acceptance of proposals on its composition in Kazakh and Russian languages.
6. The composition of the Board of Trustees is formed on the basis of proposals received with the written consent of candidates for members of the Board of Trustees, and approved by the authorized body of the relevant industry or local Executive body in the field of education within three working days after the completion of the acceptance of proposals.
7. The Board of Trustees consists of::
1) representatives of local representative, Executive and law enforcement agencies;
2) representatives of employers and social partners;
3) representatives of non-profit organizations (if any);
4) one parent or legal representative of students in this educational organization from each parallel class or course recommended by the parent Committee;;
5) charity creators (if any).
The meeting of the Board of Trustees established at the educational organization is attended by the head of this educational organization or his Deputy.
The Board of Trustees does not include persons specified in sub-paragraphs 2) and 3) of paragraph 1 of article 51 of the Law of the Republic of Kazakhstan dated July 27, 2007" on education".
8. the number of members of the Board of Trustees is formed by an odd number, not less than nine people who do not have any family or personal ties with each other and with the head of this educational organization. The term of office of the members of the Board of Trustees is three years. Members of the Board of Trustees are not part of the staff of this educational organization.
9. The number of members of the Board of Trustees who are representatives of state bodies does not exceed three people.
10. the Head of the Board of Trustees is its Chairman, who is elected (re-elected) by a majority vote by open voting at a meeting of the Board of Trustees.
Representatives of state bodies are not elected as the Chairman of the Board of Trustees and do not perform its functions.
11. in the absence of the Chairman of the Board of Trustees, by decision of the Board of Trustees, his activities are carried out by one of the members of the Board of Trustees, except for representatives of state bodies that are members of the Board of Trustees.
12. the Chairman acts on behalf of the Board of Trustees and ensures its activities in accordance with these Rules.
13. the Secretary of the Board of Trustees is appointed from among the employees of educational organizations and is not a member of the Board of Trustees.
The Secretary of the Board of Trustees provides preparation, conduct of the Board of Trustees, registration of materials and minutes of the meeting.
Chapter 3. General provisions powers of the Board Of Trustees
14. Board of Trustees of an educational organization:
1) exercise public control over the observance of the rights of students and pupils of educational organizations, as well as over the expenditure of charitable assistance received on the accounts of educational institutions;;
2) develop proposals for amendments and / or additions to the Charter of the educational organization;
3) develops recommendations on priority areas of development of the educational organization;
4) develop proposals to improve measures for the placement of orphaned children and children left without parental care in the families of Kazakhstani citizens;
5) participates in the distribution of funds received by educational organizations in the form of charitable assistance, and decides on its intended use;
6) develops proposals for the formation of the budget of the educational organization;
7) make proposals to the authorized body of the relevant industry or local Executive body in the field of education to eliminate the shortcomings identified by the Board of Trustees in the work of the educational organization;;
8) based on the results of an interview with candidates for the position of head of an educational organization, make and approve a Protocol decision;
9) hear the report of the head of the educational organization on the activities of the educational organization, including on the quality of educational services, spending charitable assistance and taking measures on the placement of orphans and children left without parental care in the families of minors;;
10) participates in conferences, meetings, seminars on the activities of the educational organization;
11) gets acquainted with the activities of the educational organization, the conditions for students and pupils who are in the educational organization, talks with the psychologist of the educational organization with them.
Employees of educational organizations (structural divisions) contribute to the provision of information on issues related to the competence of the Board of Trustees.
Chapter 4. General provisions Procedure for organizing the work of the Board of Trustees
15. the Meeting of the Board of Trustees is convened by its Chairman on his own initiative, at the initiative of two-thirds of the total number of members of the Board of Trustees.
16. Notification of the meeting of the Board of Trustees is signed by the Chairman of the Board of Trustees and sent to the members of the Board of Trustees and the educational organization where the Board of Trustees operates no later than seven working days before the meeting.
The notification shall record the date, time and place of the meeting.
The notification is accompanied by the agenda of the specified meeting by the speaker, reference materials providing the reasons for inclusion in the agenda, documents required for the meeting, submitted to the members of the Board of Trustees.
17. a Member of the Board of Trustees who has received a notification shall inform the Secretary of the Board of Trustees of his participation or non-participation in the meeting of the Board of Trustees no later than one business day before the date of the meeting of the Board of Trustees.
18. the Chairman of the Board of Trustees shall convene a meeting of the Board of Trustees no later than five working days from the date of receipt of the proposal to convene the meeting.
19. Meetings of the Board of Trustees are held as necessary, at least once a quarter.
Representatives of territorial departments of The Committee for control in the field of education and science of the Ministry of education and science of the Republic of Kazakhstan are allowed to participate in its meetings as an observer without the right to vote.
20. A meeting of the Board of Trustees is valid if all members of the Board of Trustees are informed of the time and place of the meeting and at least two-thirds of the total number of its members are present. A member of the Board of Trustees may not transfer his / her vote to another member of the Board of Trustees or to a person by proxy.
21. Each member of the Board of Trustees of an educational organization has the right to one vote without the right to transfer it.
22. The decision of the Board of Trustees is made by open vote by a majority of the members present. If the votes are equal, the decision is made, which was voted for by the Chairman of the Board of Trustees, and in the absence of the Chairman-the person acting as the Chairman of the Board of Trustees.
23. The Board's decision is finalized as Protocol, signed by all Trustees present at the meeting.
24. the Minutes are sent to the authorized body of the relevant industry or the local Executive body in the field of education no later than three working days after the meeting of the Board of Trustees.
25. the Authorized body of the relevant industry or the local Executive body in the field of education shall publish information on the decisions of the Board of Trustees on its Internet resource.
26. Charitable assistance to an educational organization is provided on a voluntary, free-of-charge basis and is directed by the decision of the Board of Trustees in accordance with the procedure provided for in these Rules.
