Analytical report on the results of the internal analysis of corruption risks in the activities of the state institution "Akim's Office of the Birlik Rural District"

The Birlik Rural District Akim's Office's activities conducted the internal analysis of corruption risks by paragraph 5 of Article 8 of the Law of the Republic of Kazakhstan "On Combating Corruption" dated 18 November 2015, standard rules for internal analysis of corruption risks approved by the order of the Chairman of the Agency of the Republic of Kazakhstan for Civil Service Affairs and Anti-Corruption dated 19th October 2016 №12, as well as based on the order of the Akim of the Birlik Rural District №58 dated 9th November 2023, an internal analysis of corruption risks was conducted from 20th November to 8th December 2023.
The internal analysis of corruption risks in the Akim's Office of Birlik Rural District is carried out in the areas of identification of corruption risks in normative legal acts affecting the activities of the district, and identification of corruption risks in the organisational activities of the Akim's Office of the district.
Identification of corruption risks in normative legal acts affecting the activities of Akim's Office of Birlik Rural District.
State Institution "Office of Akim of Birlik Rural District" Panfilov district carries out its activities by the laws and the Constitution of the Republic of Kazakhstan, acts of the President and the Government of the Republic of Kazakhstan, as well as other normative legal acts and the Regulation on the state institution "Akim's Office of Birlik Rural District". The number of acts of Akim of Rural District, adopted by Akim of the state institution "Office of Akim of Birlik Rural District" for January-December 2022-156. Of them -23 orders, decisions - 53. Orders on the main activity -57, personnel -8, on business trips -15. There were no claims from legislative supervisory authorities to the normative legal acts adopted by the Akim of the district.
Approved staff number of employees of the state institution "Akim's Office of Birlik Rural District" for 1 January 2022 - 12 people. Akim of the Rural District, deputy Akim of the district, 4 chief specialists, 1 leading specialist, 1 instructor-methodologist on youth affairs, 4 people (computer operator, guard, cleaner, driver) employees performing technical maintenance. During the analysis period there were no public servants dismissed from public service for misdemeanours.
In 2022, the institution took disciplinary action against 4 staff members.
According to paragraph 1) Paragraph 3 of Article 44 of the Law of the Republic of Kazakhstan "On Civil Service of the Republic of Kazakhstan" on the chief specialist of the state institution "The Office of the Akim of the Birlik Rural District" Kasbakova Nazipa Altayovna has imposed a disciplinary penalty in the form of a warning for improper performance of her duties on 30.03.2022.
According to paragraph 1) Paragraph 3 of Article 44 of the Law of the Republic of Kazakhstan "On Civil Service of the Republic of Kazakhstan" Kishkenebaev Turgangali Turekanovich, a leading specialist of the state institution "The office of the Akim of the Birlik rural district" has imposed a disciplinary penalty in the form of a warning for improper performance of his duties on 03 June 2022.
According to paragraph 1) Paragraph 3 of Article 44 of the Law of the Republic of Kazakhstan "On Civil Service of the Republic of Kazakhstan", the chief specialist of the state institution "The Office of the Akim of Birlik Rural District" Rakhimbai Dinara Tursymbaevna was disciplined on 28 July 2022 in the form of a warning for improper performance of her duties.
According to paragraph 1) Paragraph 3 of Article 44 of the Law of the Republic of Kazakhstan "On Civil Service of the Republic of Kazakhstan" on 28 July 2022 imposed a disciplinary sanction in the form of a warning on the chief specialist of the state institution "The Office of Akim of the Birlik Rural District" Salpiev Tokhan Igmanovich for improper performance of his duties.
According to paragraph 1) Paragraph 3 of Article 44 of the Law of the Republic of Kazakhstan "On Civil Service of the Republic of Kazakhstan", the chief specialist of the state institution "The Office of Akim of the Birlik Rural District" Salpiev Tokhan Igmanovich was given a disciplinary sanction in the form of a warning for improper performance of his duties on 21 October 2022.
There were no violations in the activities of the institution in the following areas related to the conflict of interests - conditions of joint work of spouses and close relatives in the institution; - in connection with satisfying material interests of employees, interests of close relatives, relatives or other third parties; - granting illegal privileges to individuals and/or legal entities when making decisions in the institution; - accepting any remuneration for performing their state or equivalent functions from organisations and individuals who do not perform the corresponding functions, in the form of money, services and other forms, unless otherwise provided by the legislation of the Republic of Kazakhstan; - conducting illegal business activities using the property of the institution.
In its work on the provision of public services, the office of Akim of the Birlik District is directly guided by the Law of the Republic of Kazakhstan "On Public Services" and other regulatory legal acts of the Republic of Kazakhstan in the sphere of public services.
According to the register (list) of public services approved by the Decree of the Government of the Republic of Kazakhstan dated 18 September 2013 No.983 (OD No.39 with amendments and additions dated 31.01.2020), the office of Akim of Birlik Rural District provides 5 different services. The number of services provided in 2022 is 88.
Including:
- Provision of land for the construction of facilities within settlements" -0.
- Issuing decisions on changing the purpose of land plots" -4.
- "Acquisition of state rights–owned land plots that do not require bidding (contests, auctions)" - 50.
- Sale of a land plot into ownership with immediate payment or payment in instalments" - 0.
- "Queuing for a land plot" - 34.
There are no cases of unjustified refusal to provide public services. To provide full electronic digital signature and to receive public services in electronic format exclusively through the web portal "Electronic Government", the building of the District Akim's office has been equipped and work is underway to equip the "self-service corners" with modern technical means.
It is recommended: сontinue work on the promotion of public services in electronic format.
In January 2022, the District Akim's Office received 31 appeals. All appeals were received from natural persons. There were no appeals from legal entities. Satisfied- 31.
The appeals were answered according to the requirements of the legislation of the Republic of Kazakhstan.
Work is being carried out to ensure information transparency in the application and implementation of decisions on the use of budgetary funds of the office of Akim of the Birlik District.
To ensure transparency of information on the expenditure of budgetary funds allocated to the office of Akim of the Birlik Rural District, for the conduct of public procurement procedures for works, goods, and services, by the law, an annual plan was approved and published on an electronic web portal. All public procurement was carried out by the approved annual plan.
In total, 39 public procurement contracts were signed in January - December 2022.
11 contracts were concluded using the method from one source, 21 by the method of requesting price offers.
7 contracts were concluded by open tender.
All methods of public procurement, as well as tender documents, tender announcements, opening of the application for participation in the tender and protocols on the results of public procurement by the tender method are conducted openly through the unified web portal of public procurement of the Republic of Kazakhstan.
It is recommended: тaking additional measures to increase the transparency and transparency of public procurement procedures and improve the skills of employees responsible for this area in the field of public procurement
Conclusion
The internal analysis of corruption risks in regulatory legal acts affecting the activities of the office of Akim of the Birlik District has not identified any risks in organisational and managerial activities that may contribute to the commission of corruption offences.
