             In accordance with paragraph 6 of Article 39-3 of the Law of the Republic of Kazakhstan «On local government and self-government in the Republic of Kazakhstan» and the order of the Minister of National Economy of the Republic of Kazakhstan dated June 23, 2023 №. 122 «On approval of the Model Rules for holding separate gatherings of the local community», Panfilovsky The district maslikhat DECIDED:

  1. Approve the attached rules for holding separate gatherings of the local community in the Panfilovsky district in accordance with the appendix to this decision
  2. is decision comes into effect upon the expiration of ten calendar days after the day of its first official publication.

    Rules for holding separate gatherings of the local community in the Panfilovsky district

     Chapter 1. General provisions

     

                1. These rules for holding separate gatherings of the local community were developed in accordance with paragraph 6 of Article 39-3 of the Law of the Republic of Kazakhstan “On Local Government and Self-Government in the Republic of Kazakhstan” and establish the procedure for holding separate gatherings of the local community of residents of a city of district significance, village, town, rural district.
    1. These Rules use the following basic concepts:

    1) separate gathering of the local community - direct participation of residents (members of the local community) of a city of district significance, village, town, rural district, microdistrict, street, apartment building in the election of representatives to participate in the gathering of the local community;

     2) local community - a set of residents (members of the local community) living on the territory of the corresponding administrative-territorial unit, within the boundaries of which local self-government is carried out, its bodies are formed and function.

    Chapter 2. The procedure for holding separate meetings of the local community

     
    1. To conduct a separate gathering of the local community, the territory of a city of regional significance, a village, a township, a rural district is divided into sections (villages, microdistricts, streets, multi-apartment residential buildings).
                4. At separate gatherings of the local community, representatives of no more than three people are elected to participate in the gathering of the local community.      5. The akim of a city of district significance, a village, a settlement and a rural district convenes and organizes a separate gathering of the local community within the village, microdistrict, street, apartment building.      If there are apartment buildings within a microdistrict or street, separate meetings of the apartment building are not held.
    1. The population of the local community is notified about the time, place of convening separate meetings of the local community and the issues discussed by the akim of the city of regional significance, village, township, rural district no later than ten calendar days before the day of its holding through the media or other means.
    2. Before the opening of a separate gathering of the local community, registration of the present residents of the corresponding village, microdistrict, street, or apartment building is carried out.

          Participation in a separate gathering of the local community by minors, persons recognized by the court as incompetent, as well as persons held in places of deprivation of liberty by a court verdict is not allowed.

          A separate gathering of the local community is considered to have taken place with the participation of at least ten percent of residents (members of the local community) living in a given village, microdistrict, street, apartment building.

    1. A separate gathering of the local community is opened by the akim of a city of regional significance, a village, township, rural district or a person authorized by him.

          The chairman of a separate gathering of a local community is the akim of a city of district significance, village, township, rural district or a person authorized by him.

          At a separate meeting of the local community, minutes are kept; to draw up the minutes of the separate meeting of the local community, a secretary is elected by open vote.

    1. Candidates for representatives of residents of a village, microdistrict, street, apartment building to participate in a local community gathering are nominated by participants in a separate local community gathering in accordance with the quantitative composition approved by the maslikhat of the Panfilov district.
    2. Voting is carried out in an open manner personally for each candidate. The candidates who receive the largest number of votes from participants in a separate gathering of the local community are considered elected.

          The chairman of a separate gathering has a casting vote if, when voting at a separate gathering of a local community, the votes of the participants are equally divided.

    1. The protocol of the separate gathering of the local community is signed by the chairman and secretary and, within two working days from the date of the separate gathering, is transferred by the secretary of the gathering to the office of the akim of the corresponding city of district significance, village, town and rural district for registration.

          At a local community meeting or local community meeting, minutes are kept indicating:

          1) date and place of the local community gathering or local community meeting;

          2) the total number of members of the local community living in the relevant territory and having the right to participate in a gathering of the local community or at a meeting of the local community;

    3) the number and list of those present, indicating the last name, first name, patronymic (if any);

          4) last name, first name, patronymic (if any) of the chairman and secretary of the local community gathering or local community meeting;

          5) agenda, content of speeches and decisions made.
