Analytical report on the results of an internal analysis of corruption risks in the activities of the administration of the akim of the Baskunchi rural district.
INTRODUCTION
Based on Article 8, paragraph 5 of the Law on Corruption (hereinafter referred to as the Law), the provisions approved by Order No. 12 dated October 19, 2016 «On Conducting an Internal Analysis of Corruption Risks» by the Chairman of the Civil Service and Anti-Corruption Agency, in accordance with the order of the Akim of the Baskunchi rural district No. 60 dated On December 02, 2022, an internal analysis of corruption risks was carried out covered by the period II-III-IV quarter of 2021 in the activities of the administration of the akim of the Baskunchi rural district.
The state institution «Apparatus of Akim of the Baskunchi rural district» of the Panfilov district carries out its activities in accordance with the Constitution and laws of the Republic of Kazakhstan, acts of the President and the Government of the Republic of Kazakhstan, other regulatory legal acts, as well as 3d. Sheet of this Regulation (Regulation) approved No. 474 dated September 15, 2016 by the Panfilov district akimat.
According to the order No. 12 approved by the Chairman of the Agency «Civil Service and Anti-Corruption» dated October 19, 2016, this regulation on the internal analysis of corruption risks, the internal analysis was carried out in the following areas:
The state institution «Apparatus of Akim of the Baskunchi rural district» of the Panfilov district carries out its activities in accordance with the Constitution and laws of the Republic of Kazakhstan, acts of the President and the Government of Kazakhstan, other regulatory legal acts, as well as 3 sheets of this Regulation (Regulation) approved №474 dated September 15, 2016 Panfilov district akimat.
The akim of the state institution «Apparatus of the akim of the Baskunchi rural district» for the past II-III-IV quarters of 2021 adopted 133 regulatory legal acts. Of these 68 orders, 65 decisions. On the part of the supervisory authorities for the adopted regulatory legal acts, no claims were made to the akim of the district. Rendered public services-30.
Until now, there have been no complaints from the supervisory authorities for the adopted regulatory legal acts addressed to the akim of the district, however, sometimes there are corruption risks among the decisions taken by the akim of the district. In many cases, these risks are observed when decisions are made to extend the use of leased land for housing construction and farming, or for maintenance of a built house and farming. Here, the conclusion of the district commission on land acquisition is issued later than 1 month, when the akim of the district must make a decision on land acquisition within months, after the conclusion of the district commission on land acquisition.
For notes: So that the district land committee issues the conclusion of the district land commission on the allotment of land plots in a timely manner, without missing a month, to the residents of the district who submitted documents to receive the conclusion of the commissions on the extension of decisions for temporary use.
1)Personal management, personnel change.
According to the resolution of the akim of the Panfilov district, according to the state for the II-III-IV quarters of 2021, the total number of civil servants in the apparatus of the district akim is 8 units.
Reapproved in accordance with the changes made to this regulation, the conformity of civil servants to the official categories approved by the head of the department of Almaty region.
To date, 8 states correspond to the approved ones. The number of civil servants in the apparatus of the akim of the district corresponds to 8. According to the national composition, all 8 civil servants are of Kazakh nationality. Of these, 5 are male, 3 are female.
In accordance with Article 14 of the Law of the Republic of Kazakhstan dated November 18, 2015 No. 410-V ZRK «On Combating Corruption», close family relations between administrative workers are not identified.
In the region, the change of personnel is based on not exceeding the standard at the level of 9%, for the II-III-IV quarters of 2021, each specialist of the district akim's office works in their places, there was no change of personnel in the district akim's office.

2) About observance of periodicity of increase qualifications of administrative civil servants:
The rules for the training, retraining and advanced training of civil servants, approved by Decree of the President of the Republic of Kazakhstan dated October 29, 2015 No. 152, provide that civil servants of the corps <<B>> undergo advanced training at least once every three years.
In accordance with the schedule approved for 2021, 2 civil servants were trained in the Almaty regional branch of the Academy of Public Administration, 1 civil servant was trained online.
3) Settlement of conflict of interest
In accordance with Article 15 of the Law of the Republic of Kazakhstan on combating corruption dated November 18, 2015 №410-V ZRK no conflict of interest was identified.
4) On the imposition of disciplinary sanctions on civil servants.
From among the civil servants of the “Apparatus of Akim of the Baskunchi rural district”, 1 civil servant was brought to justice.
Public services rendered in the state institution «Apparatus of akim of the Baskunchi rural district»:
- Acquisition of rights to land plots that are state-owned, not requiring bidding (auction competitions);
- Issuance of decisions to change the purpose of the land plot;
- Putting on the queue for obtaining a land plot;
- Sale of land in private ownership at a time or in installments;
- Presentation of a land plot for the construction of an object within the boundaries of a settlement;
Public services will also be provided through electronic portal “Egov”.
In order to inform the population about the procedure for the provision of public services provided in accordance with the Law of the Republic of Kazakhstan «On Public Services», a board with posted standards and regulations of public services is placed in the apparatus. Helpline 45-0-41 is constantly working.
In the course of the analysis of the provision of public services, the facts of the provision of services with overdue dates were revealed. For this, the civil servant was brought to responsibility, to an administrative penalty.
In the course of the analysis of violations of the requirements of the Law of the Republic of Kazakhstan “On the procedure for considering applications from individuals and legal entities”, it was not established.
For the II-III-IV quarters of 2021, the district akim's office received 56 applications. All 56 of them are from an individual. Of these, 56 have been clarified.
CONCLUSION
Based on the above, the working group to identify the internal analysis of corruption risks makes a decision on the absence of corruption risks in the activities of the apparatus of the district akim.
