About the approval of the Rules for the provision of social support measures to specialists in the field of health, education, social security, culture, sports and agro-industrial complex, civil servants of the akims of villages, settlements, rural districts who arrived to work and live in rural settlements

To approve the attached Rules for the provision of social support measures to specialists in the field of health, education, social security, culture, sports and agro-industrial complex, civil servants of the akims of villages, settlements, rural districts who arrived to work and live in rural settlements.

The Department of Regional Policy and Development of Local Self-Government (Tungyshbekov S.) to provide:
1) the state registration of this order in the Ministry of Justice of the Republic of Kazakhstan and its official publication in the information and legal system "Adilet" and in the official mass media;
2) placement of this order on the official Internet resource of the Ministry of National Economy of the Republic of Kazakhstan.
Control over the execution of this order should be entrusted to the Vice-Minister of National Economy of the Republic of Kazakhstan K.A. Uskenbayev.
This order shall enter into force upon the expiration of ten calendar days after the date of its first official publication.

Chapter 1. General provisions
These Rules for the provision of social support measures to specialists in the field of healthcare, education, social security, culture, sports and agro–industrial complex, civil servants of the akims of villages, settlements, rural districts who arrived to work and live in rural settlements (hereinafter referred to as the Rules), have been developed in accordance with the laws of the Republic of Kazakhstan dated July 8, 2005 of the Year "On State Regulation of the development of the agro–industrial complex and rural areas" (hereinafter - the Law), dated April 15, 2013 "On Public Services" (hereinafter – The Law on Public Services) and the Budget Code of the Republic of Kazakhstan dated December 4, 2008, and determine the procedure for providing specialists in the field of health, education, social security, culture, sports and agro–industrial complex, civil servants of the akims of villages, settlements, rural districts who arrived to work and live in rural settlements (hereinafter - service recipients), by decision of local representative bodies (maslikhats)lifting allowance and social support for the purchase or construction of housing at the expense of budgetary funds.

The provision of social support measures to service recipients is a public service and is provided by authorized bodies in the field of rural development of local executive bodies of districts and cities of regional significance (hereinafter referred to as the service provider).
The list of the main requirements for its provision, including the characteristics of the process, form, content and result of the provision, as well as other information, taking into account the specifics of the provision of public services, is set out in the standard of public services "Provision of social support measures to specialists in the field of health, education, social security, culture, sports and agro-industrial complex, civil servants of village akims, settlements, rural districts, arrived for work and residence in rural settlements" according to Appendix 1 to these Rules.

Chapter 2. The procedure for providing social support measures to specialists in the field of healthcare, education, social security, culture, sports and agro-industrial complex, civil servants of the akims of villages, settlements, rural districts who arrived to work and live in rural settlements

Lifting allowance and social support for the purchase or construction of housing is provided to service recipients specified in paragraph 8 of Article 18 of the Law.
At the same time, civil servants of the akims of villages, settlements, rural districts who have arrived to work and live in rural settlements, a lifting allowance and social support for the purchase or construction of housing are provided subject to the restrictions provided for in paragraph 12 of Article 56 of the Law of the Republic of Kazakhstan dated November 23, 2015 "On Public Service of the Republic of Kazakhstan".

Social support measures in the form of a budget loan for the purchase or construction of housing cannot be used for the purchase of housing from close relatives (spouse, grandparents, parents (including adoptive parents), children (including adopted), full- and half-siblings), as well as for the purchase of residential premises in which a citizen permanently resides.
Budget loans are provided to local executive bodies of the regions through the conclusion of loan agreements on the following conditions:
with subsequent provision to specialists in the field of healthcare, education, social security, culture, sports, agro-industrial complex and civil servants of the akims of villages, settlements, rural districts who arrived to work and live in rural settlements, for the purchase or construction of housing in tenge for up to fifteen years at a remuneration rate of 0.01% annual;
the loan development period is calculated from the moment of transfer of loans from the lender's account and is 22 (twenty-two) months.

The local executive body of the district (city of regional significance) for the coming period forms a list of demanded specialties in the field of health, education, social security, culture, sports, agro–industrial complex and civil servants of the akims of villages, settlements, rural districts (hereinafter - the list), which is posted on the akimat's Internet resource within one working day district (city of regional significance) and is provided to the non-profit joint stock Company "State Corporation "Government for Citizens" (hereinafter – State Corporation) for information.
The list indicates the name and number of service recipients and/or their specialties, for which social support measures will be provided in the form of a lifting allowance and a budget loan for the purchase or construction of housing for the upcoming period.
The local representative body (maslikhat) of the district (city of regional significance) annually decides on the provision of social support measures to service recipients in the form of a lifting allowance and a budget loan for the purchase or construction of housing.

Provision of a lifting allowance and a budget loan for the purchase or construction of housing to service recipients is carried out within the allocated amounts, according to the financing plans for obligations and payments for the corresponding financial year.
The working body for the provision of social support measures is the service provider.
