I COMMAND YOU:
Make the following changes to the Order of the Minister of National Economy of the Republic of Kazakhstan No. 72 dated November 6, 2014 "On Approval of the Rules for providing social support measures to Specialists in the field of health, education, social Security, culture, sports and Agro-industrial complex who arrived to work and live in rural settlements" (registered in the Register of State Registration of Regulatory Legal Acts No. 9946, published on December 26, 2014 in the information and legal system "Adilet") :
the title of the order should be worded as follows:
"On the approval of the Rules for the provision of social support measures to specialists in the field of health, education, social security, culture, sports and agriculture, civil servants of the offices of akims of villages, settlements, rural districts, who arrived to work and live in rural settlements";
paragraph 1 of the order should be worded as follows:
"1. To approve the attached Rules for the provision of social support measures to specialists in the field of health, education, social security, culture, sports and agro-industrial complex, civil servants of the offices of akims of villages, settlements, rural districts, who arrived to work and live in rural localities.";
in the Rules for the provision of social support measures to specialists in the field of health, education, social security, culture, sports and agro-industrial complex, who arrived to work and live in rural localities, approved by the specified order:
the title should read as follows:
"Rules for the provision of social support measures to specialists in the field of health, education, social security, culture, sports and agro-industrial complex, civil servants of the offices of the akims of villages, settlements, rural districts, who arrived to work and live in rural localities";
paragraphs 1 and 2 should read as follows:
"1. These Rules for the provision of social support to professionals in the field of health, education, social welfare, culture, sports and agriculture, government officials of akim of villages, settlements, rural districts, who came to live and work in rural communities (hereinafter – Rules) are developed in accordance with the laws of the Republic of Kazakhstan of July 8, 2005 "On state regulation of development of agroindustrial complex and rural territories" (hereinafter – the Law), from the 15th April 2013 "On state services" (hereinafter – The Law on Public Services) and the Budget Code of the Republic of Kazakhstan of December 4, 2008, and determine the procedure for providing specialists in the field of health, education, social security, culture, sports and agro-industrial complex, civil servants of the offices of akims of villages, settlements, rural districts who arrived to work and live in rural localities (hereinafter-service recipients), by decision of local representative bodies (maslikhats)lifting allowance and social support for the purchase or construction of housing at the expense of budget funds.
The provision of social support measures to service recipients is a public service and is provided by the authorized bodies in the field of rural development of local executive bodies of districts and cities of regional significance (hereinafter referred to as the service provider).
A list of the main requirements of its provision, including the characteristics of the process, form, content and result of the provision, as well as other data with the features of the provision of public services set out in the standard of the state service "Provision of social support to experts in the field of health, education, social welfare, culture, sports and agriculture, government officials of akim of villages, settlements, rural districts, arrived for work and residence in rural localities " in accordance with Annex 1 to these Rules.";
The title of chapter 2 should read as follows:
"Chapter 2. The procedure for providing social support measures to specialists in the field of health, education, social security, culture, sports and agro-industrial complex, civil servants of the offices of akims of villages, settlements, rural districts who arrived to work and live in rural localities";
paragraph 3 should be worded as follows:
"3. The lifting allowance and social support for the purchase or construction of housing is provided to the service recipients specified in paragraph 8 of Article 18 of the Law.
In this state officials of akim of villages, settlements, rural districts, who came to live and work in rural communities, mobility allowance and social support for the acquisition or construction of housing is subject to the restrictions under paragraph 12 of article 56 of the Law of the Republic of Kazakhstan of November 23, 2015 "On state service of the Republic of Kazakhstan".";
paragraphs 5 and 6 should read as follows:
"5. Budget loans are provided to local executive bodies of the regions through the conclusion of loan agreements on the following conditions:
with the subsequent provision to specialists in the field of health, education, social security, culture, sports, agro-industrial complex and civil servants of the offices of akims of villages, settlements, rural districts, who arrived to work and live in rural settlements, for the purchase or construction of housing in tenge for up to fifteen years at a remuneration rate of 0.01 % per annum;
The loan disbursement period is calculated from the moment the loans are transferred from the lender's account and is 22 (twenty-two) months.
The local Executive authority of the district (city of regional significance) for the upcoming period generates a list of popular specialties in the field of health, education, social welfare, culture, sports, agriculture and public officials of akim of villages, settlements, rural districts (hereinafter – the list), which within one business day it is posted on the Internet resource of the district akimat (city of regional significance) and is non-profit joint stock company "State Corporation "Government for citizens" (hereinafter – State Corporation) for information.
The list indicates the name and number of service recipients and / or their specialties, for which social support measures will be provided in the form of a lifting allowance and a budget loan for the purchase or construction of housing for the upcoming period.
The local representative body (maslikhat) of the district (city of regional significance) annually decides on the provision of social support measures to service recipients in the form of a lifting allowance and a budget loan for the purchase or construction of housing.";
paragraphs 9 and 10 should read as follows:
"9. Budget loans for the purchase or construction of housing for specialists in the field of health, education, social security, culture, sports and agriculture, civil servants of the offices of akims of villages, settlements, rural districts are subject to a contract with a lawyer (agent).
The mayor of the district (city of regional significance) enters into a contract with an attorney (agent) for the implementation of the budget loan service providers for the purchase or construction of housing in accordance with the legislation of the Republic of Kazakhstan.
Funds for reimbursement of expenses for the operational services of the attorney (agent) for the implementation of the budget program for lending to service recipients for the purchase or construction of housing are provided within the local budget in accordance with the budget legislation.
In order to receive social support measures, the service recipient or his representative, under a notarized power of attorney (when submitting documents through a State Corporation), provides the service provider with the following documents through a State Corporation or in electronic format through the web portal of "electronic government" (hereinafter referred to as the Portal)::
1) when receiving the lifting allowance:
application form in accordance with Annex 2 to these Rules;
personal identification document (for identification purposes);
a copy of the diploma of education;
a copy of the document confirming the employment of the service recipient;
2) when receiving a budget loan for the purchase of housing:
application form in accordance with Annex 2 to these Rules;
personal identification document (for identification purposes);
a copy of the diploma of education;
a copy of the document confirming the employment of the service recipient;
certificate of state registration of marriage (matrimony) (for service recipients who are married) for identification;
report from the Credit Bureau;
3) when obtaining a budget loan for housing construction:
application form in accordance with Annex 2 to these Rules;
personal identification document (for identification purposes);
a copy of the diploma of education;
a copy of the document confirming the employment of the service recipient;
certificate of state registration of marriage (matrimony) (for service recipients who are married) for identification;
a report from the Credit Bureau.
The requirement to submit other documents that are not provided for in these Rules is not allowed.
