In order to implement the task set by the Head of the State, relevant amendments were adopted to the Constitutional Law "On the Judicial System and Status of Judges of the Republic of Kazakhstan", which entered into force on October 1, 2024.

The new mechanism provides that all submissions of the higher court, which indicate a gross violation of the law by the judges of the lower courts, will be the subject of consideration by the Judicial Jury. "For the gross violations of the law committed during the consideration of court cases and due to non-compliance with the Code of Judicial Ethics the disciplinary penalties such as warning, reprimand, and the most severe punishment - dismissal from judicial office are set”, - the Chairman of the Judicial Jury Nurzhan Kayypzhan said.

In addition, the composition of the Judicial Jury was expanded from 9 to 15 members. Now it consists of the representatives of legal community, which corresponds to international practice and contributes to greater work transparency. "The judicial jury cannot be considered as a punitive body that deals only with issues of responsibility of judges.

The main goal of the jury is to ensure their independence and protection from unlawful disciplinary action. We have neither the moral nor the legal right to punish without proper grounds during considering disciplinary cases against judges," said the judge of the Supreme Court of the Republic of Kazakhstan, the member of the Judicial Jury Yessenbai Boranbayev.

It should be noted that Dmitriy Malakhov, the Chairman of the Supreme Judicial Council of the Republic of Kazakhstan, also pays special attention to the work of the Judicial Jury, to the independence of judges and protection of their rights within disciplinary proceedings.
