Often, the consumer is faced with a violation of their rights and does not know how to act correctly to protect their rights. At the same time, only a few people decide to protect their rights, and this is largely due to ignorance of the appeal procedure.
First, you need to write a complaint to the seller (manufacturer, contractor) about the elimination of offenses. If you have a product or cash receipt stored, then its details must include information about the seller, his IIN or BIN, and legal address.
The complaint must be drawn up in two copies, one of which is submitted to the seller (manufacturer, contractor), and the other-the seller (manufacturer, contractor) makes a note of receipt. In the complaint, the consumer indicates the last name, first name, actual address, as well as the contact phone number that the seller (manufacturer) can contact for clarification. The text of the complaint must indicate when and where the product was purchased, name, article, size, model, etc. After that, you need to describe why you are dissatisfied with the product or why the product is defective.
The most important thing in the claim is the description of the claim. It should be clear and formulated in accordance with the legislation. At the end of the complaint, you must put the date and signature of the complaint. It is advisable to attach supporting documents to the complaint.
If for any reason the seller (manufacturer, contractor) refuses to accept the complaint or sign your copy, send the complaint by registered mail with a notification of receipt. You can also leave a complaint to any employee of the seller (manufacturer, performer) in the presence of two witnesses who may be your relatives or acquaintances. Then, in the second copy, you need to make a note with the signatures of witnesses and together with the addresses and passport data that the complaint was filed in the presence of witnesses. At the same time, it should be borne in mind that these witnesses may then be called to court as witnesses to confirm the fact of filing (filing) a complaint.
After receiving the complaint, the seller (manufacturer, contractor) must make a decision on the procedure for considering your claim. For example, when making a quality check decision, it should inform you about its time and place. If the presence of a defect is not disputed, but as a result of a quality check, the seller (contractor) believes that the reason for the occurrence of defects is your culpable actions (for example, violation of the rules of storage or use) or inaction (for example, failure to comply with maintenance requirements), then the seller is obliged to conduct an expert examination. The consumer has the right to participate in both quality checks and expertise.
If your claim is not satisfied, once again assess the legality of your claims, perhaps consult with subjects of pre-trial settlement of consumer disputes, such as lawyers, mediators and public associations for consumer protection. You can also apply to the court with the help of a pre-trial Consumer Dispute Settlement entity that protects your rights.
