When the price of the goods at the checkout does not match the price tag

It is not uncommon for a customer in a store, planning to purchase a particular product, to be surprised to find that the price for it turned out to be higher. And it turns out that when a person has already approached the checkout.

Such tricks happen quite often and are not always noticeable to the consumer. Someone begins to wonder if he himself was mistaken, looking at the price tag? Someone agrees with the cost revealed at the checkout, not wanting to waste time arguing. Someone simply refuses to take the goods. But if the purchase is large, then the amount of damage can be significant. But how can and should one actually behave in such a situation?

Seeing that the price at the checkout differs from the one indicated, you need to go to the hall and take a photo of the price tag for the desired product. Then you need to invite the store administrator and inform him about the fact of violation of consumer rights, namely, about the price difference itself.

According to paragraph 12 of Article 24 of the Law of the Republic of Kazakhstan "On Consumer Protection", the seller is obliged to indicate the value of the goods. The goods displayed in the internal and external storefronts of the shopping facility are decorated with a price label. The price that the store put on the price tag is a public offer, that is, a kind of formal agreement between the store and the buyers, so the seller is obliged to sell the goods, and the consumer has the right to buy the goods at exactly the price indicated in the offer.

Moreover, if the seller puts the final price higher than indicated on the label, or there is no price tag on the product at all, then he faces a penalty of up to 200 MCI, depending on the category of the business entity, according to Article 193 paragraphs 4 and 5 of the Administrative Code of the Republic of Kazakhstan. If, however, the goods were sold at a price other than that indicated on the price tag, the consumer has the right to demand from the seller a refund of the overpaid amount.

And if the administration of the outlet refuses to make a refund, the buyer has the right to write a claim to the management demanding payment of the difference between the amount indicated on the price tag and the amount actually received. If the management of the retail facility has not responded to the written claim and has not returned the money within 10 calendar days, the consumer can apply to the state agency performing functions in the field of consumer protection, or to the subject of pre-trial settlement of consumer dispute with a claim for a penalty (fine, fine) in the amount of at least one percent of the value of the goods for each day of delay from the date of the claim to the day of satisfaction of the requirements, according to paragraph 6 of Article 30 of the Law of the Republic of Kazakhstan "On Consumer Protection".
