Yesterday, the Head of State signed the Law of the Republic of Kazakhstan "On Amendments and Additions to the Code of the Republic of Kazakhstan on Administrative Offenses".
Earlier, the President instructed to strengthen consumer protection in the field of communications, introduce and tighten responsibility for a significant discrepancy between the real parameters of Internet communication from those declared by operators.
In the implementation of this instruction, the Ministry of Digital Development, Innovation and Aerospace Industry (MDDIAI), together with the deputy corps, has developed measures aimed at strengthening the responsibility of operators for providing users with communication services that do not meet standards, technical standards and quality indicators.
Now, in case of violations, telecom operators will be fined 1000 MCI instead of 100 MCI, and in case of repeated violations during the year, the amount of the fine will increase from 200 to 1500 MCI.
According to an analysis conducted by the Ministry of Digital Development, Innovation and Aerospace Industry, the number of complaints about poor communication quality has increased 10-fold. According to the results of 2021, the Ministry conducted 562 inspections (51 inspections were carried out in 2020, and 93 in 2019).
To check the operator for poor quality of communication or the Internet, Kazakhstanis need to send an official appeal to the Telecommunications Committee (MDDIAI) or the territorial communications inspectorate of the Ministry of the relevant region through the portal of "electronic government", the system of filing appeals "E-Finish" or in paper form. In the appeal, it is mandatory to indicate the subject of the complaint, the name of the telecom operator and the exact address of the applicant, where it is necessary to conduct an inspection.
After receiving the appeal, an act on the appointment of an inspection is registered with the prosecutor's office. During the inspection, measurements are carried out on the quality of the communication services provided. If violations are detected against the operator, an administrative protocol is drawn up in the form of a fine in accordance with article 637 of the Code of Administrative Offenses and an order is made to eliminate violations for a period established by an official.
The adopted changes are another step in providing the population with high-quality communications and the Internet.
