The internal analysis of corruption risks was carried out in accordance with the Rules of Internal Analysis of Corruption Risks approved by the order of the Minister for Civil Service Affairs of the Republic of Kazakhstan dated December 29, 2015.
I have studied the laws, regulatory legal acts, legal acts that the department is guided by in its activities.
During the study of the position of the state body, the main functions affecting the activities of the Department of Natural Resources and Environmental Management of the East Kazakhstan Region and related regulatory legal acts were analyzed (Forest Code of the Republic of Kazakhstan dated July 08, 2003 No. 477, Environmental Code of the Republic of Kazakhstan dated January 09, 2007 No. 212, Environmental Code of the Republic of Kazakhstan dated January 2, 2021 No. 400-VI ZRK, Water Code of the Republic of Kazakhstan dated July 09, 2003 No. 481, the Law of the Republic of Kazakhstan "On the Protection of, reproduction and use of the animal world" dated July 09, 2004 No. 593). According to the results of the analysis of discretionary powers and norms that contribute to the commission of corruption offenses, it was not revealed.
However, the analysis revealed the need to bring some regulatory acts of management into compliance in connection with changes in industry-specific regulations. Namely, changes in the Water Code of the Republic of Kazakhstan, the Forest Code of the Republic of Kazakhstan, the entry into force of the Environmental Code of the Republic of Kazakhstan on July 1, 2021, the adoption of the SAM "On Aquaculture". Thus, it is necessary to optimize the Management Position and, accordingly, the positions of departments and job descriptions. At the same time, to develop a single Charter for all KSU forestry enterprises, taking into account the requirements of current legislation.
In the organizational and managerial activities of the department, the following areas were subjected to anti-corruption analysis:
personnel management, including staff turnover;
The full-time number of the department is 27 units of civil servants, 33 units of freelance workers.
There is no turnover of frames.
Employees of the department and subordinate institutions were checked by means of the Information Service database of the Committee on Legal Statistics and Special Records under the Prosecutor General's Office of the Republic of Kazakhstan for corruption offenses within the framework of the entry into force of the Law of the Republic of Kazakhstan dated December 30, 2020 "On Amendments and Additions to some legislative acts of the Republic of Kazakhstan on the implementation of certain provisions of the Address of the Head of State to the People of Kazakhstan dated September 1, 2020 "Kazakhstan in a new reality: time for action". Namely, in terms of the requirement of subparagraph 2) of paragraph 2 of Article 26 of the Labor Code to prevent the employment of quasi-public sector entities of a person who has committed a corruption crime. According to the results of the audit of 1,500 employees, that is, since the entry into force of the Law of the Republic of Kazakhstan dated December 30, 2020 (entered into force on 10.01.2021) employment of persons with corruption offenses has not been recorded.
There were no negative materials in the mass media regarding the civil servants of the department.
2) conflict of interest settlement and 3) implementation of permissive functions and implementation of control functions;
The following facts were revealed during the trial
Employees of the KSU "Markakol Forestry" (subordinate management institution) at the site "Kyzyltas" of the GPKZRK "Ontustik Altai" revealed a violation of environmental legislation, namely the removal of the upper fertile layer of land thereby causing damage to the state in the amount of 66,205,500 tenge.
During the inspection, it was established that "CANA STROI" LLP carried out geological exploration work on the basis of the contract No. 121-TPI for the state geological study of the subsoil concluded with the republican state institution "Committee of Geology and Subsoil Use of the Ministry of Investment and Development of the Republic of Kazakhstan". The conclusion of the abovementioned agreement includes a whole set of approvals by the interested bodies. Thus, the structural subdivision of the department, based on the results of an environmental assessment conducted by the authorized body in the field of environmental protection (Deparatmnet Ecology of East Kazakhstan Region), issued a permit for emission into the environment since the developer did not indicate the presence of an OPT on the territory where geological exploration was planned.
Thus, a corruption risk has arisen. The structural division of the department issues a permit for emission into the environment. The subordinate institution, in turn, initiates a lawsuit for illegal geological exploration on the territory of the protected area.
3) provision of public services;
Corruption risks in the direction of the quality of public services have not been identified. The Department annually, together with the office of the akim of the region, conducts internal control over the quality of public services. These measures contribute to the timely provision of methodological assistance to subordinate institutions, as well as prompt response and elimination of violations In addition, this year the Department for Civil Service Affairs conducted external control over the quality of public services both in the management and subordinate institutions of violations were not detected.
Based on the above, corruption risks occur in the activities of the Department, but the management takes measures to eliminate them.
