How can a labor migrant from an EAEU country obtain the “Insured” status?

According to paragraph 3 of Article 2 of the Law on Compulsory Medical Insurance, foreigners and members of their families temporarily staying on the territory of the Republic of Kazakhstan in accordance with the terms of an international treaty ratified by the Republic of Kazakhstan, enjoy the rights and bear responsibilities in the system of compulsory social health insurance on an equal basis with citizens of the Republic of Kazakhstan, unless otherwise not provided for by laws or international treaties.

At the same time, family members of a labor migrant are the spouse and children living together. This paragraph applies to labor migrants from the EAEU countries (Russian Federation, Belarus, Armenia, Kyrgyzstan).

In accordance with paragraph 3 of Article 98 of the EAEU Treaty, social insurance of workers of member states and members of their families is carried out on the same conditions and in the same manner as citizens of the state of employment.

The Fund reverses the debt of labor migrants on the basis of the following documents: an application, a copy of the employment contract, a copy of the temporary residence permit (TRP), where the purpose of stay is indicated as “work”.

For a family member of a labor migrant, debt reversal is carried out upon provision of the following documents: application, marriage certificate, spouse's TD, temporary residence permit (where there should be a record of family members of the migrant worker).

At the same time, a non-working family member of a migrant worker participates in the compulsory medical insurance system as an independent payer. Insurance status is assigned to a labor migrant if there are payments for compulsory medical insurance from the employer from the month of labor activity, and to a family member of a labor migrant - if there are payments as an independent payer.
