Chapter 1. General provisions
district of the Samar district of the East Kazakhstan region" is a state institution that ensures the activities of the akim of the rural district and carries out other functions provided for by the legislation of the Republic of Kazakhstan.
district of the Samar district of the East Kazakhstan region" carries out its activities in accordance with the Constitution and laws of the Republic of Kazakhstan, acts of the President and Government of the Republic of Kazakhstan, other regulatory legal acts, as well as this Regulation on the Akim’s apparatus.
district of the Samar district of the East Kazakhstan region" is a legal entity in the organizational and legal form of a state institution, in accordance with the legislation of the Republic of Kazakhstan, it has seals and stamps with its name in the state language, standard forms, accounts with treasury authorities.

district of the Samar district of the East Kazakhstan region" has the right to act as a party to civil law relations on behalf of the state in accordance with the law.

Chapter 2. Main tasks, functions, rights and responsibilities
11.Tasks:
Information-analytical, organizational-legal, material and technical support for the activities of the akim, as well as resolving issues of local importance.
12.Functions:
1) State institution “Apparatus of Akim of Sarybel rural
district of the Samar district of the East Kazakhstan region" within its competence:
- ensures the organization of a gathering of the local community, a separate gathering of the local community of residents of a village, street, apartment building, meeting of the local community;
- notifies about the time, place of convening a separate gathering of the local community, gathering and meeting of the local community and the issues discussed no later than ten calendar days before the day of their holding through the media or other means;
- ensures the execution of decisions made at a local community meeting or a local community meeting and approved by the akims of the rural district;
- ensures planning and execution of the rural district budget;
- presents a report on the execution of the rural district budget to the local community meeting and the district maslikhat;
- makes decisions on the implementation of the rural district budget;
- develops and submits a local community development program for approval to the local community meeting;
- acts as a customer for the construction, reconstruction and repair of facilities related to the communal property of the rural district;
- exercises control over the targeted and effective use of municipal property of local government;
- exercises the rights of the subject of communal property rights in relation to communal legal entities of local government;
- establishes for a municipal state enterprise, the property of which is in the communal property of a rural district (municipal property of local government), a period
maintaining and ensuring the safety of seized property until it is transferred to another person with subsequent write-off from the balance sheet;
- represents the interests of the state on issues of communal property of local government, protects the property rights of the rural district (municipal property of local government);
- exercises control over the fulfillment by the trustee of obligations under the trust management agreement for municipal property of local government;
- monitors and analyzes the implementation of development plans for municipal state enterprises, the property of which is in the communal property of the rural district (municipal property of local government);
- organizes accounting of municipal property of local government, ensures its effective use;
2) State institution “Apparatus of Akim of Sarybel rural
district of the Samar district of the East Kazakhstan region" in agreement with the meeting of the local community:
- develops draft legal acts in the field of management of municipal property of local self-government within its competence;
- manages the communal property of local government, unless otherwise provided by the laws of the Republic of Kazakhstan, takes measures to protect it;
- makes a decision and carries out the privatization of municipal property of local government, including ensuring its safety in the process of preparing the object for privatization, attracting an intermediary to organize the privatization process, providing an assessment of the privatization object, preparing and concluding purchase and sale agreements for the privatization object and monitoring compliance terms of purchase and sale agreements;
- determines the subject and goals of the activities of a communal state enterprise, the property of which is in the communal property of a rural district (municipal property of local self-government), as well as the type of communal state enterprise (on the right of economic management or a state-owned enterprise) carrying out such activities;
- carries out the withdrawal or redistribution of property transferred to a municipal legal entity of local self-government or acquired by it as a result of its own economic activities;
- carries out the seizure of excess, unused or misused property of municipal legal entities of local self-government;
- provides municipal property of local government for property lease (lease), trust management to individuals and non-state legal entities without the right of subsequent redemption or with the right of subsequent redemption;
- makes decisions on the creation, reorganization, change of name and liquidation of municipal legal entities of local self-government in agreement with the akim of the district (city of regional significance);
- gives consent to the public utility enterprise to alienate or otherwise dispose of the property assigned to it (with the exception of the sale of products produced by it), to create branches and representative offices, as well as to transfer and write off receivables;
- approves the charter (regulations) of state legal entities of local self-government, introducing amendments and additions to it;
- determines priority areas of activity and mandatory volumes of work (services) financed from the budget of municipal state enterprises, the property of which is in the communal property of the rural district (municipal property of local government);
- considers, coordinates in cases provided for by the Law of the Republic of Kazakhstan “On State Property”, and approves plans for the development of state enterprises, the property of which is in the communal property of the rural district (municipal property of local self-government), and reports on their implementation;
- makes decisions on the use of municipal property of local government, including its transfer as collateral, lease, gratuitous use and trust management;
- assigns communal property of local government to communal legal entities of local government;
- makes a decision on the alienation of municipal property of local government;
- exercises other powers granted by the legislation of the Republic of Kazakhstan.
- request and receive the necessary information, documents and other materials from officials of government bodies and other organizations;
- acquire and exercise property and non-property rights;
- use information databases of government bodies, archives, scientific institutions;
- conclude contracts and agreements;
- have other rights provided for in accordance with the legislation of the Republic of Kazakhstan.
- provide high-quality public services to the population in accordance with current legislation;
- efficiently and timely execute acts and instructions of the President, the Government of the Republic of Kazakhstan and other central executive bodies, akim and akimat of the region, district;
- carry out other duties provided for by current legislation.
Chapter 3. Organization of activities of the akim’s apparatus
Sarybel rural district of Samar district, East Kazakhstan region
- Considers appeals, applications, complaints from citizens, takes measures to protect the rights and freedoms of citizens;
- facilitates the collection of taxes and other obligatory payments to the budget;
- promotes the implementation by citizens and legal entities of the norms of the Constitution of the Republic of Kazakhstan, laws, acts of the President and Government of the Republic of Kazakhstan, normative legal acts of central and local government bodies;
- within the limits of its competence, regulates land relations;
- ensures the preservation of the communal housing stock of the rural district, as well as the construction, reconstruction, repair and maintenance of highways in the rural district;
- promotes the organization of peasant or farm enterprises, the development of entrepreneurial activity;
- provides measures of state support for social entrepreneurship in accordance with the entrepreneurial code of the Republic of Kazakhstan;
- within the limits of its competence, organizes and ensures the implementation of the legislation of the Republic of Kazakhstan on issues of military duty and military service, mobilization training and mobilization, as well as in the field of civil protection;
- organizes work to preserve historical and cultural heritage;
- identifies low-income people, makes proposals to higher authorities to ensure employment, provide targeted social assistance, organizes services for lonely elderly and disabled citizens at home, coordinates the provision of charitable assistance to them;
- promotes the employment of persons released from institutions of the penal system who are registered with the probation service, and also provides them with social, legal and other assistance in accordance with the legislation of the Republic of Kazakhstan;
- organizes the performance of notarial acts, receives documents for registration of acts of civil status of citizens living on their territory, and transfers them to the civil registration authority of the region for state registration of acts of civil status and entering information into the state database about individuals, as well as issuance and delivery of certificates and, if necessary, certificates about the procedure established by the legislation of the Republic of Kazakhstan;
- organizes assistance to persons with disabilities;
- organizes public works, youth practice and social work places;
- organizes, together with the authorized body in the field of physical culture and sports and public associations of persons with disabilities, the holding of recreational and sports events among persons with disabilities;
- organizes, together with public associations of persons with disabilities, cultural and educational events;
- coordinates the provision of charitable and social assistance to persons with disabilities;
- coordinates the provision of charitable assistance to socially vulnerable segments of the population;
- promotes staffing of rural health care organizations;
- facilitates the allocation of housing to mothers awarded the “Altyn Alka” pendant;
- organizes the performance of public works by persons sentenced to this type of punishment in the manner determined by the authorized body in the field of criminal enforcement activities;
- promotes the development of local social infrastructure;
- organizes the movement of public transport;
- in case of emergency assistance, organizes the delivery of patients to the nearest healthcare organization providing medical care;
- provides assistance to state veterinary organizations;
- interacts with local authorities;
- takes part in the work of sessions of the district maslikhat when approving (clarifying) the local budget;
- organizes, within its competence, water supply to populated areas and regulates water use issues;
- organizes works on improvement, lighting, landscaping and sanitary cleaning of populated areas;
- organizes the burial of the homeless and public works to maintain cemeteries and other burial places in proper condition;
- maintains records and registration of land plots intended for graves, in accordance with the rules of burial and organization of the care of graves;
- maintains a register of public mediators;
- creates infrastructure for sports activities for individuals at their place of residence and in places of their public recreation;
- promotes the employment of convicts serving sentences in institutions of the penal system, including by:
- placing orders for goods, works and services produced, performed and provided by enterprises and institutions of the penal system;
- provide district communal property transferred to management for property lease (lease) to individuals and non-state legal entities without the right of subsequent redemption;
- determine priority areas of activity and mandatory volumes of work (services) financed from the budget of transferred public utility enterprises;
- ensures the safety of transferred communal property;
- manages the transferred district communal legal entities;
- coordinates the annual financial statements of the district public utility enterprise transferred to the management, approved by the decision of the local executive body;
- sets prices for goods (work, services) produced and sold by public utility enterprises transferred to management;
budget funds and (or) revenues provided for by the legislation of the Republic of Kazakhstan on local government and self-government;
- draws up and approves a consolidated plan for the receipts and expenditures of money from the sale by state institutions of goods (works, services) remaining at their disposal, in accordance with the budget legislation of the Republic of Kazakhstan;
- conducts an inventory of the housing stock of the rural district;
- organizes, in agreement with the district akim and the local community meeting, the demolition of emergency housing in the rural district;
- provides assistance to microcredit to the rural population within the framework of program documents of the state planning system;
- maintain household records in accordance with the statistical methodology approved by the authorized body in the field of state statistics;
- organizes the maintenance of registration records in the form approved by the authorized body in the field of state statistics;
- ensure the reliability of household accounting data;
- exercises other powers assigned by laws and other regulatory legal acts of the Republic of Kazakhstan.
Chapter 4. Property of the apparatus of the akim of the rural district
The property of the state institution “Apparatus of the Akim of the Sarybelsky rural district of the Samar region of the East Kazakhstan region” is formed from the property transferred to it by the owner, as well as property (including cash income) acquired as a result of its own activities and other sources not prohibited by the legislation of the Republic of Kazakhstan.
