On December 20, 2019, the heads of the countries of the Eurasian Economic Union (EAEU) signed an agreement on the provision of pensions for workers of the Member States of the Eurasian Economic Union, which will regulate the provision of pensions for workers of the EAEU countries and their families. Despite the fact that this Agreement has been signed, it will enter into force only after ratification by the parliaments of all EAEU countries.
However, citizens of the EAEU countries, including citizens of the Republic of Kazakhstan who work in the EAEU countries, need to know the following: 1) the EAEU countries include: Armenia, Belarus, Kazakhstan, Kyrgyzstan and Russia; 2) The agreement determines that the worker is a citizen of a member state of the EAEU, whose pension rights are formed or formed through the implementation of labor or other activities in the territory of another member state; 3) the formation of the pension rights of workers is carried out at the expense of pension contributions on the same conditions and in the same manner as the formation of the pension rights of citizens of the state of employment.
Moreover, pension contributions include: in Armenia - taxes and (or) other contributions giving the right to a pension; in Belarus - insurance contributions for compulsory pension insurance; in Kazakhstan - pension contributions to the unified accumulative pension fund; in Kyrgyzstan - Pension insurance contributions fund and State accumulative pension fund; in Russia - insurance contributions for compulsory pension insurance.
In each of the EAEU countries, pension contributions are deducted for workers who are officially employed, that is, work under a labor or civil law contract, respectively, if a citizen works in the shadow sector, then pension contributions will not be paid for him and will not apply to him. this Agreement. In this regard, to workers, including citizens of the Republic of Kazakhstan, carrying out or planning to carry out labor activities in the EAEU countries, in order to
the formation of pension rights and their subsequent implementation under the Agreement (receiving a pension for work experience acquired in the EAEU countries after the entry into force of the Agreement), it is imperative to conclude labor or civil law contracts with employers.
