Appeal of Zhandos Umiraliev, who is the Deputy Prosecutor General in accordance with Article 40 of the Constitutional Law of the Republic of Kazakhstan "On the Prosecutor's Office"

DEAR CITIZENS!

Calls for holding and participating in unsanctioned rallies on April 9, 2023 are spreading on social networks.

The Prosecutor General's Office has repeatedly warned of statutory liability for organizing and participating in such actions.

Ensuring public order, safety of life and health of the population, observance of the rights and freedoms of citizens are our main priorities.

Therefore, we again draw attention to the need to comply with the norms of the Law “On the procedure for organizing and holding peaceful assemblies, rallies, marches, pickets and demonstrations in the Republic of Kazakhstan” and the inadmissibility of their violation.

Mass public events should be held with prior notification and obtaining permission from local executive bodies in specially designated places with the adoption of measures that exclude obstacles to the normal functioning of life support facilities for the population.

If these norms are not observed, any public appeals are recognized as illegal. Administrative and criminal law measures will be taken against offenders by law enforcement agencies.

Thus, the organization and participation in rallies, marches, meetings or demonstrations held in violation of the requirements of the Law (paragraph 3 of Article 3) is illegal and entails liability under Article 488 of the Code of Administrative Offenses up to 25 days of arrest.

For causing significant damage as a result of these actions, the perpetrators will be held criminally liable under Article 400 of the Criminal Code in the form of a fine or correctional labor in the amount of up to 200 MCI or community service for up to 200 hours or arrest for up to 50 days.

In this regard, the Prosecutor General's Office urges to strictly observe the norms of the current legislation, not to succumb to provocations and to refrain from organizing and participating in illegal actions, as well as public calls for them.
