Кодекстің 74-бабына сәйкес, жұмыскерлердің әлеуметтік-тұрмыстық және өзге де жеке қажеттіліктерін өндіріс мүдделерімен үйлестіру мақсатында жұмыскерлер үшін икемді жұмыс уақыты режимі белгіленуі мүмкін.

Икемді жұмыс уақыты режимі кезінде: 1) белгіленген жұмыс уақыты; 2) жұмыскер сол уақыт ішінде еңбек міндеттерін өз қалауы бойынша атқаруға құқылы икемді (ауыспалы) жұмыс уақыты; 3) есептік кезең белгіленеді.
Оның шегінде жұмыскерлердің осы санаты үшін орташа белгіленген жұмыс уақытының ұзақтығы сақталуға тиіс кезең икемді жұмыс уақыты кезіндегі есептік кезең деп танылады.

Қашықтықтан жұмыс кезінде еңбекақы қалай төленеді?

Меншік нысанына қарамастан, мемлекеттік және жеке меншік барлық кәсіпорындар қашықтықтан жұмыс режиміне ауыса алады.

Тараптардың келісімі бойынша және егер өндіріс процесі мүмкіндік берсе, карантин кезеңінде жұмыс беруші қашықтан жұмыс жасауға құқылы. Кодекстің 138-бабына сәйкес, қашықтықтан жұмыс істеу жұмыс процесінде ақпараттық-коммуникациялық технологияларды пайдалана отырып, еңбек процесін жұмыс беруші орналасқан жерден тысқары жерде жүзеге асырудың ерекше нысаны болып табылады. Жұмыс беруші жұмыскерге коммуникация құралдарын (байланыс құралдарын) береді және оларды орнату мен оларға қызмет көрсету жөніндегі шығыстарды көтереді. Жұмыскер меншікті коммуникация құралдарын тұрақты негізде пайдаланған жағдайда, жұмыс беруші өтемақы төлейді, оның мөлшері мен төлеу тәртібі жұмыскермен келісім бойынша белгіленеді.

Тараптардың келісімі бойынша қашықтықтан жұмыс істейтін жұмыскерге жұмыс беруші үшін жұмысты орындауға байланысты өзге де шығыстар (электр энергиясының, судың құны және және басқа да шығыстар) өтелуі мүмкін.

Қашықтан жұмыс істейтін қызметкерлер үшін жұмыс уақытының тұрақты есебі жасалады, бақылау ерекшеліктері еңбек шартында айқындалады. Бұл жағдайда жұмысты орындау шарттары, жұмыс уақытының есебі, шығындар тараптардың келісімі бойынша (жұмыс берушінің актісі, еңбек шарты) белгіленеді, ал жалақы нақты жұмыс істеген уақыт үшін төленеді.

Ата-ананың біреуіне ақылы демалыс беру туралы не айтуға болады?

Еңбек кодексінің 93-бабына сәйкес, жұмыскерлерге жыл сайынғы ақы төленетін еңбек демалысын берудің кезектілігі жыл сайын жұмыс беруші жұмыскерлер пікірін ескере отырып бекітетін демалыстар кестесіне сәйкес айқындалады не тараптардың келісімі бойынша демалыстар кестесінен тыс белгіленеді. Осыған байланысты жұмыс берушілер жыл сайынғы ақылы еңбек демалысын балаларымен бірге отыруға мәжбүр болған ата-аналардың біреуіне бере алады немесе беруге міндетті.

Егер ата-аналардың екеуі де еңбек демалысында болып келген жағдайда, Кодекстің 97-бабына сәйкес, еңбек шарты тараптарының келісімі бойынша, жұмыскердің өтініші негізінде оған жалақы сақталмайтын демалыс берілуі мүмкін. Жалақы сақталмайтын демалыстың ұзақтығы жұмыскер мен жұмыс берушінің арасындағы келісім бойынша айқындалады.

Әлеуметтік төлем кімге және қалай төленеді?

Жалақы сақталмайтын демалыстағы адамдар үшін МӘСҚ (Мемлекеттік әлеуметтік сақтандыру қорынан) ай сайын әлеуметтік төлем 42500 теңге мөлшерінде төленеді.

Әлеуметтік төлемдерді алуға құқығы бар адамдардың санаттары: микро, шағын және орта кәсіпорындардың қызметкерлері, карантин енгізілген елді мекендердегі ірі кәсіпорындардың қызметкерлері, жеке кәсіпкерлер, жеке тәжірибемен айналысатын адамдар (нотариус, жеке сот орындаушысы, адвокат, кәсіби медиатор), бірыңғай жиынтық төлемді төлеушілер, азаматтық-құқықтық келісімшарттар бойынша табыс алатын жеке тұлғалар.

Өтінімді жұмыс беруші (жұмысшының өзі де жібере алады) жұмыспен қамтудың жергілікті органына, «Электрондық үкімет» веб-порталындағы «Электрондық үндеу» қызметі арқылы, төтенше жағдай кезіндегі қызметіне байланысты шектеулерге байланысты жалақысы сақталмайтын демалысқа жіберілген қызметкерлердің тізімін қоса береді.

Как будет оплачиваться больничный лист на период домашнего карантина?

В соответствии п.1-3 ст.133 Трудового кодекса РК (далее-Кодекс), работодатель обязан за счет своих средств выплачивать работникам социальное пособие по временной нетрудоспособности. Основанием для выплаты социальных пособий по временной нетрудоспособности являются листы временной нетрудоспособности, выданные в порядке, определенном уполномоченным органом в области здравоохранения. Социальные пособия по временной нетрудоспособности выплачиваются работникам с первого дня нетрудоспособности до дня восстановления трудоспособности или до установления инвалидности в соответствии с законодательством Республики Казахстан.

Размеры социального пособия по временной нетрудоспособности определяются постановлением Правительства РК от 28 декабря 2015 года №1103 «Об определении размеров социального пособия по временной нетрудоспособности», согласно которому размер пособия, выплачиваемого за один месяц, не может превышать пятнадцатикратной величины месячного расчетного показателя за соответствующий год (МРП=2651 тенге), т.е. 39765 тенге.

Кроме того, в рамках мер по недопущению распространения коронавирусной инфекции ограничена деятельность отдельных организаций.

Как работодатель может осуществить введение режима неполного рабочего времени?

Согласно ст.70 Кодекса, по письменному соглашению между работником и работодателем работнику может устанавливаться неполное рабочее время. Неполным рабочим временем считается время, которое меньше нормальной продолжительности, установленной настоящим Кодексом, в том числе: 1) неполный рабочий день, то есть уменьшение нормы продолжительности ежедневной работы (рабочей смены);

2) неполная рабочая неделя, то есть сокращение числа рабочих дней в рабочей неделе;

3) одновременное уменьшение нормы продолжительности ежедневной работы (рабочей смены) и сокращение числа рабочих дней в рабочей неделе.

Оплата труда при этом будет осуществляться пропорционально фактически отработанному времени.

Как осуществляется режим гибкого рабочего времени?

Режим гибкого рабочего времени – особая форма организации рабочего времени, режима работы, основанной на суммированном учете рабочего времени, при котором учитываются интересы работников и производства. Такой режим применяется как при пяти, так и шестидневной рабочих неделях и может устанавливаться на определенной срок или неопределенный срок.

Согласно ст.74 Кодекса, для работников может устанавливаться режим гибкого рабочего времени. При режиме гибкого рабочего времени устанавливаются: фиксированное рабочее время; гибкое (переменное) рабочее время, в течение которого работник вправе по своему усмотрению выполнять трудовые обязанности; учетный период.

Учетным периодом при гибком рабочем времени признается период, в пределах которого должна быть соблюдена в среднем установленная для данной категории работников продолжительность рабочего времени.

Как будет производится оплата труда при дистанционной работе?

Все предприятия, как и государственные, так и частные, вне зависимости от форм собственности, которые могут перейти на дистанционный режим работы, должны это сделать.

По соглашению сторон и в случае если позволяет производственный процесс, в период карантина работодатель вправе установить дистанционную работу. Согласно ст.138 Кодекса, дистанционная работа является особой формой осуществления трудового процесса вне места расположения работодателя с применением в процессе работы информационно-коммуникационных технологий. Работодатель предоставляет работнику средства коммуникаций (средства связи) и несет расходы по их установке и обслуживанию.

В случае, когда работник использует собственные средства коммуникаций на постоянной основе, работодателем выплачивается компенсация, размер и порядок выплаты которой устанавливается по соглашению с работником. По соглашению сторон дистанционному работнику могут возмещаться и иные расходы, связанные с выполнением работы для работодателя (стоимость электроэнергии, воды и другие расходы).

Для работников, занятых на дистанционной работе, устанавливается фиксированный учет рабочего времени, особенности контроля за которым определяются в трудовом договоре. В данном случае условия осуществления работы, учет рабочего времени, расходы устанавливаются по соглашению сторон (актом работодателя, трудовым договором), а оплата заработной платы производится за фактически отработанное время.

Как на счет предоставления оплачиваемых отпусков для одного из родителей?

Согласно ст.93 Кодекса, предоставление очередного трудового отпуска осуществляется в соответствии с графиком отпусков или вне графика по соглашению сторон в случае возникновения такой необходимости. В связи с этим работодатели могут или обязаны предоставляют одному из родителей, вынужденных оставаться с детьми, оплачиваемый ежегодный трудовой отпуск.

В случае, оба родителя уже побывали в трудовом отпуске, согласно ст.97 Кодекса, по соглашению сторон трудового договора на основании заявления работника ему может быть предоставлен отпуск без сохранения заработной платы. Продолжительность отпуска без сохранения заработной платы определяется по соглашению между работником и работодателем.

Командированные возвращаются из других городов в г.Усть-Каменногорск, какие меры по карантину принять как работодателю?

Перевести своих работников на дистанционный режим работы, с сохранением 100% оплаты труда, либо направить в оплачиваемый трудовой отпуск.

В случае вынужденного простоя, оплата устанавливается в размере не ниже минимального размера заработной платы (42 500 тенге). Однако, оплата простоя может быть выше минимального размера заработной платы по соглашению сторон между работником и работодателем.

Если, Вы примете решение о том, что направите работников в отпуска без содержания, в случае Ваше предприятие не относится к субъекту крупного предпринимательства, Вы должны направить список работников в центр занятости либо зарегистрировать его на портале egov.kz для возможности получения Вашими работниками социальной выплаты в размере 42500 тенге.

ПРАВОВОЕ СОПРОВОЖДЕНИЕ

За что возможно наложение штрафа и в каких размерах?

Невыполнение мер и временных ограничений (ст. 476 КОАП РК) – штраф 10 МРП или арест до 15 суток

Неповиновение представителям власти (ст. 379 УК РК) – штраф 2 тыс. МРП или до 2 лет лишения свободы;

Неповиновение требованиям полиции (ст. 667 КОАП РК) – штраф до 40 МРП или арест до 10 суток);

Невыполнение предписания органов санэпиднадзора (ст. 462 КОАП РК) – штраф до 500 МРП;

Нарушение санитарных правил и гигиенических норм (ст. 425 КОАП РК) – штраф до 5 млн тенге;

Нарушение санитарных правил и гигиенических норм, повлекшее смерть (ст. 304 УК РК) – штраф 2 тыс. МРП или лишение свободы до 10 лет;

Распространение заведомо ложной информации, создающей опасность нарушения общественного порядка или причинения существенного вреда правам и законным интересам граждан или организаций либо охраняемым законом интересам общества или государства, совершенное в условиях чрезвычайного положения (ч. 4 ст. 274 УК РК) – ограничение свободы на срок от трех до семи лет либо лишение свободы на тот же срок.

Как будут работать суды?

В связи с введением чрезвычайного положения областным судом принят ряд мер. Местным судам рекомендовано: проводить судебные процессы дистанционно с применением IT-технологий (ВКС, мобильного приложения TrueConf); отложить на более поздние сроки рассмотрение судебных дел, по которым процессуальные сроки не наступили (в том числе путем приостановления, отложения, продления сроков и т. д.); отменить выездные заседания судов, рассмотрение уголовных дел и материалов с сокращенными сроками разрешения (материалы, рассматриваемые следственными судьями, дела ускоренного, приказного, согласительного производства и т. д.), административных дел рекомендуется осуществлять в условиях максимальной изоляции и безопасности для вовлеченных лиц; по уголовным делам и материалам, административным делам, по которым лица содержатся под стражей, задержаны, арестованы, участие указанных лиц обеспечить только путем ВКС без конвоирования в здание суда; в целях обеспечения своевременного начала судебного заседания установить в каждом суде графики рассмотрения дел и материалов с применением ВКС.
