On approval of the Rules for the provision of social and legal assistance to persons registered with the probation service

Together with the Employment Center, a working meeting was held in connection with the introduction of amendments to the Decree of the Government of the Republic of Kazakhstan dated October 23, 2014 No. 1131 “On approval of the Rules for the provision of social and legal assistance to persons registered with the probation service” of convicts registered with the probation service of Kurchum district DIS in East Kazakhstan region

Employees of the Probation Service of the Kurchum region No. 1, No. 2 of the DIS for East Kazakhstan region together with employees of the department of employment and social programs and registration of acts of civil status of the Kurchum region in connection with the amendments to the Decree of the Government of the Republic of Kazakhstan dated April 13, 2022 No. 217, Government Decree Republic of Kazakhstan dated October 23, 2014 No. 1131 discussed the procedure for providing social and legal assistance to people.
The main tasks of the probation service;
The probation service, when registering persons subject to probation, with the determination of the place of residence, state of health, level of education and employment of the person, explains to them the procedure for providing assistance in obtaining education, mastering a profession, employment, treatment, as well as providing legal assistance and obtaining other social and legal assistance.
Local executive bodies organize the process related to the provision of social and legal assistance to persons subject to probation, in accordance with the legislation of the Republic of Kazakhstan.
1. Medical care is provided within the guaranteed volume of free medical care and (or) in the system of compulsory social health insurance in state healthcare organizations.
2. a person subject to probation, who has an incomplete secondary education, applies to educational institutions at the place of residence.
3. legal assistance to persons subject to probation is provided in:
1) execution of legally significant documents for filing documents for receiving social benefits due under the law, special payments, for employment, training, medical care in case of lack of funds;
2) legal advice on the statutory rights to social assistance, social security and ways to protect against their violations;
3) assistance in obtaining benefits, allowances and other social payments established by law, contributing to the solution of issues that create conditions for getting out of a difficult life situation.
Persons in respect of whom probation is applied, for the provision of legal assistance, apply to local executive bodies at their place of residence.
4. When providing employment assistance to a person subject to probation, local executive bodies shall carry out the following activities:
1) Referral of the unemployed to available vacancies in the vacancies database of the authorized body / Employment Center;
2) Direction of the unemployed to social jobs;
3) Sending the unemployed to public works upon their agreement;
4) Sending the unemployed to vocational training, retraining and advanced training in accordance with the demands of the labor market, with subsequent assistance in finding employment;
5) establishment of quotas for the employment of persons registered with the probation service or released from places of deprivation of liberty. At the same time, the payroll number of employees of the sending party does not include employees involved in work in accordance with the contract for the provision of services for the provision of personnel.
5. After the expiration of the period of probation control, administrative supervision and deregistration of the probation service, the social and legal assistance provided by state bodies and other organizations in accordance with the legislation of the Republic of Kazakhstan continues.
6. The probation service, within three working days after receiving the court order, sends a notification to the local executive body and the organization providing social and legal assistance to suspend social and legal assistance in respect of persons put on the wanted list, who have been assigned a measure of restraint "arrest".
7. Illegal actions of employees of local executive bodies, public associations and other organizations providing social and legal assistance may be appealed in the manner prescribed by law.
As noted above, the employees of the Probation Service No. 1, No. 2 of the Kurchum District, together with the employees of the Department of Employment and Social Programs of the Kurchum District, are working to provide the indicated social and legal assistance to convicts who are registered with the Probation Service No. 1, No. 2 of the Kurchum District .
