In accordance with article 8 of the Law of the Republic of Kazakhstan dated may 25, 2020 "on the procedure for organizing and holding peaceful assemblies in the Republic of Kazakhstan", with subparagraph 15) of paragraph 1 of article 6 of the Law of the Republic of Kazakhstan dated January 23, 2001 "on local state administration and self-government in the Republic of Kazakhstan", the maslikhat of the Altai district DECIDED:

  1. Determine specialized places for organizing and holding peaceful assemblies in the Altai region in accordance with the Annex to this decision.
  2. Recognize some decisions of the maslikhat of the Altai region as invalid:

1) decision of the Altai region maslikhat No. 45/4-VI dated February 26, 2019 "on additional regulation of the procedure for holding meetings, rallies, marches, pickets and demonstrations" (registered in the Register of state registration of normative legal acts No. 5755, published in the Reference control Bank of normative legal acts of the Republic of Kazakhstan in electronic form on March 18, 2019);

2) decision of the maslikhat of the Altai region dated October 16, 2019 No. 54/3 - VI "on amending the decision of the maslikhat of the Altai region dated February 26, 2019 No. 45/4-VI "on additional regulation of the procedure for holding meetings, rallies, marches, pickets and demonstrations" (registered in the Register of state registration of normative legal acts for No. 6227, published in the Reference control Bank of normative legal acts of the Republic of Kazakhstan in electronic form on November 20, 2019).

  1. This decision shall enter into force upon the expiration of ten calendar days after the date of its first official publication.

Identification of specialized places for organizing and holding peaceful assemblies in the Altai region

  1. Peaceful assemblies shall be held in accordance with the purposes specified in the application, at a specified time and place.
  2. Place of peaceful Assembly in the city of Altai-the square of the center of Culture;
  3. the Processions follow the following route:

in the city of Altai-from the Central square of the city to the center of Culture on the street Tauelsizdik.

  1. when conducting peaceful assemblies, the authorized persons (organizers), as well as other participants, shall observe public order.
  2. Peaceful assemblies are held in specialized places for organizing and holding peaceful assemblies. It is prohibited to hold peaceful meetings in other places, except for picketing.
  3. When defining specialized areas for the organization and holding of peaceful meetings and the procedure for their use shall be capable of achieving the goal of peaceful Assembly, the establishment of specialized places for organization and holding peaceful assemblies in Central and other parts of the administrative-territorial units, ease of organization, the use of the organizers and participants of peaceful Assembly infrastructure, compliance with sanitary norms and rules, security of organizers and participants of peaceful Assembly of others.

7.if several organizers of peaceful assemblies simultaneously claim to hold a peaceful Assembly in the same place and / or along the same route or at the same time, the order of use of the specified place is determined by the local Executive body, based on the time of receipt of the relevant notification or application from the organizer of peaceful assemblies.

  1. Peaceful assemblies may not start earlier than 9 o'clock and end later than 20 o'clock local time of the administrative-territorial unit on the day of peaceful assemblies.
  2. The picketing is prohibited:

1) in places of mass graves;

2) at railway, water, air and road transport facilities and adjacent territories;

3) in the territories adjacent to organizations that ensure the defense capability, security of the state and the life of the population;

4) on territories adjacent to dangerous production facilities and other facilities whose operation requires compliance with special safety regulations;

5) on main railway networks, main pipelines, the national electric network, main communication lines and adjacent territories.

  1. it is Not allowed to hold two or more pickets in the same place at the same time at the same object, except for specialized places for organizing and holding peaceful meetings.

The duration of picketing should not exceed two hours a day in the same place at the same object, except for specialized places for organizing and holding peaceful meetings.

  1. Organizers and participants are not allowed:

1) to call for violation of the Constitution of the Republic of Kazakhstan, laws and other normative legal acts of the Republic of Kazakhstan, mass riots, inciting social, racial, national, religious, class and ancestral discord, propagandize or publicly call for the seizure or retention of power, forcible change of the constitutional system of the Republic of Kazakhstan;

2) perform actions that interfere with the smooth functioning of transport, infrastructure, the safety of green spaces and small architectural forms, and other property, as well as hinder the free movement of citizens who do not participate in peaceful assemblies;

3) obstruct the activities of state bodies, organizations, and officials when they carry out a set of measures to protect the life, health, rights and freedoms of a person and citizen, the interests of society and the state, protect public order, and ensure public safety during peaceful assemblies;

4) involve private security organizations in ensuring public order and security of participants in peaceful assemblies;

5) install yurts, tents, and other structures without the consent of the local Executive body;

6) carry cold, firearms and other weapons, as well as specially prepared or adapted items (substances, products) that can be used against the life and health of people, to cause material damage to citizens and property of legal entities;

7) to distribute and (or) consume alcoholic products, narcotic drugs, psychotropic substances, their analogues, as well as to be in a state of alcoholic, narcotic and (or) toxic intoxication;

8) use items of clothing and (or) other means that prevent face recognition, with the exception of personal protective equipment aimed at protecting health;

9) use symbols aimed at violating the Constitution of the Republic of Kazakhstan, laws and other normative legal acts of the Republic of Kazakhstan, inciting social, racial, national, religious, class and ancestral strife, as well as symbols and illustrative materials of terrorist or extremist organizations prohibited in accordance with the laws of the Republic of Kazakhstan when conducting agitation and peaceful assemblies.

  1. Peaceful Assembly in the absence of the organizer or organizer's representative is not allowed.
  2. Notification of holding peaceful assemblies in the form of picketing, Assembly, meeting is submitted by the organizer of peaceful assemblies to the local Executive body on paper or in the form of an electronic document certified by an electronic digital signature, no later than five working days before the day of its holding.
  3. The day of notification on holding a peaceful Assembly shall be the date of registration of a notice in the local Executive authority.
  4. In the notification on holding a peaceful Assembly shall specify:

1) the purpose of a peaceful Assembly;

2) form of peaceful Assembly;

3) last name, first name, patronymic (if available), individual identification number, place of residence or temporary residence (residence) of a citizen of the Republic of Kazakhstan-organizer of peaceful assemblies, his representative (if available) , or name, business identification number, location of the legal entity-organizer of peaceful assemblies;

4) a specialized place for organizing and holding peaceful meetings, and a place for pickets;

5) date, time of the beginning and end of the peaceful Assembly;

6) estimated number of participants;

7) information about the establishment of yurts, tents and other structures;

8) the intention to use sound-amplifying technical means, posters, banners and other means of visual agitation in the cases provided for by this Law;

9) rules of conduct of peaceful assemblies approved by the organizer, except for picketing;

10) e-mail address, mobile phone number of the organizer of peaceful assemblies, its representative (if available);

11) consent of the organizer of peaceful assemblies or his representative (if any) to the collection and processing of his personal data specified in the notification;

12) sources of funding for peaceful assemblies;

13) the date of the notification of peaceful Assembly and the signature of the organizer or his representative (if any).

  1. Logistical and organizational support for peaceful Assembly they are the organizer and the participants at the expense of own means and funds and property collected and (or) transferred to carry out these peaceful meetings, if the present Law and other laws of the Republic of Kazakhstan provides otherwise.
  2. it is Prohibited to Finance the organization and conduct of peaceful assemblies:

1) individuals and (or) legal entities included in the list of organizations and persons associated with the financing of the proliferation of weapons of mass destruction, and (or) in the list of organizations and persons associated with the financing of terrorism and extremism;

2) a legal entity whose activity is suspended or prohibited in accordance with the procedure established by the law of the Republic of Kazakhstan;

3) foreigners, stateless persons and foreign legal entities.

  1. it is Prohibited to establish yurts, tents, or other structures in specialized places for organizing and holding peaceful assemblies without the consent of the local Executive body.
