"Assignment of social assistance to certain categories of needy citizens by decisions of local representative bodies"
The state service "Assignment of social assistance to certain categories of needy citizens according to the decisions of local representative bodies" is provided to persons who have fallen into a difficult life situation of the Department of Employment and Social Programs of the City of Sarani.
To receive a public service, the service recipient on his own behalf or on behalf of the family applies to the State Institution "Department of Employment and Social Programs of the city of Sarani" (hereinafter referred to as the service provider) or the akim of the village of Aktas by submitting a written application with the following documents attached:
1) identity document (required for identification);
2) information about the income of a person (family members);
3) an act and/or a document confirming the occurrence of a difficult life situation.
To receive social assistance, which is assigned regardless of the income of a person (family members), information about the income of a person (family members) is not provided.
The documents are submitted in originals for verification, after which the documents are returned to the service recipient.
To the portal:
for the provision of public services – application;
to obtain information about the provision of public services – a request in the form of an electronic document certified by the electronic digital signature of the service recipient.
The information of an identity document, a document confirming registration at a permanent place of residence, a document confirming disability, a document confirming that a person has a socially significant disease specified in an electronic application, the service recipient receives from the relevant state information systems through the gateway of the "electronic government".
The total period for reviewing documents and issuing the results of the provision of public services from the date of receipt and registration of the package of documents by the service provider is eight working days.
When submitting a full package of documents, the service recipient is issued:
the service provider or akim of the village of Aktas has a coupon indicating the date of registration and the date of receipt of the state service, the surname and initials of the person who accepted the documents;
through the portal – in the "personal account" of the service recipient, the status of acceptance of the request for the provision of public services is displayed.
The result of the provision of public services:
Notification of the decision taken or a reasoned response to the refusal to provide a public service.
On the portal, the notification of the appointment of social assistance, as well as information about the appointment of social assistance, is sent to the "personal account" of the service recipient in the form of an electronic document certified by an electronic digital signature of an authorized person of the service provider.
Grounds for refusal to provide public services:
1) identification of false information provided by the applicants;
2) refusal, evasion of the applicant from conducting a survey of the financial situation of the person (family);
3) exceeding the size of the average per capita income of a person (family) established by local representative bodies of the threshold for the provision of social assistance;
4) the negative response of the authorized state body to the request for approval, which is required for the provision of public services, as well as the negative conclusion of the examination, research or verification;
5) the absence of the consent of the service recipient, provided in accordance with Article 8 of the Law of the Republic of Kazakhstan "On Personal Data and their Protection", for access to restricted personal data required for the provision of public services.
The service recipient has the right to appeal the decision, action (inaction) of the service provider, official in accordance with paragraph 1 of Article 91 of the CPC of the Republic of Kazakhstan.
The complaint is submitted to the service provider, an official whose decision, action (inaction) is being appealed.
The service provider, the official whose decision, action (inaction) is being appealed, no later than three working days from the date of receipt of the complaint, send it and the administrative case to a higher administrative body (hereinafter referred to as the body considering the complaint).
At the same time, the service provider, an official whose decision, action (inaction) is being appealed, has the right not to send a complaint to the body considering the complaint if he makes a decision within three working days, performs an action that fully satisfies the requirements specified in the complaint.
In case of disagreement with the results of the rendered public service, the service recipient has the right to file a complaint with the authorized body for evaluation and quality control of public services in accordance with paragraph 2 of Article 25 of the Law of the Republic of Kazakhstan "On Public Services".
The complaint of the service recipient received by the service provider directly providing public services is subject to consideration within five working days from the date of its registration.
The complaint of the service recipient received by the authorized body for the assessment and control of the quality of public services is subject to consideration within fifteen working days from the date of its registration.
Unless otherwise provided by the laws of the Republic of Kazakhstan, an appeal to the court is allowed after an appeal in a pre-trial manner in accordance with paragraph 5 of Article 91 of the CPC of the Republic of Kazakhstan.
In accordance with the Rules for Providing Social assistance, establishing the size and determining the list of certain categories of needy citizens of the city of Sarani and the village of Aktas (approved by the decision of the Saransk City Maslikhat No. 279 of December 12, 2013), social assistance is provided on memorable dates and holidays and when a difficult life situation occurs.
Memorable dates and holidays include:
1) on the Day of the withdrawal of a limited contingent of Soviet troops from the Democratic Republic of Afghanistan – February 15:
servicemen of the Soviet Army, Navy, State Security Committee, officials of the commanding and ordinary staff of the Ministry of Internal Affairs of the former USSR (including military specialists and advisers), who, in accordance with the decisions of the government bodies of the former USSR, took participation in military operations on the territory of other states;
conscripted, called up for training camps and sent to Afghanistan during the period of combat operations;
military personnel of automobile battalions sent to Afghanistan to deliver goods to this country during the period of hostilities;
to the military personnel of the flight crew who flew combat missions to Afghanistan from the territory of the former USSR;
workers and employees who served the Soviet military contingent in Afghanistan, who were wounded, concussed or maimed, or awarded orders and medals of the former USSR for participation in providing combat operations;
persons equated on benefits to persons with disabilities due to injury, contusion, injury or illness received during the Great Patriotic War;
2) Nauryz Meiramy – March 21-23:
children with a disease caused by the human immunodeficiency virus;
persons with tuberculosis during outpatient treatment;
children from large families who are brought up and studying in preschool organizations;
persons with disabilities of group 1 who have an individual rehabilitation program for sanatorium treatment, who have chosen a ticket for sanatorium treatment through the social services portal, or in accordance with the legislation of the Republic of Kazakhstan on public procurement;
3) Defender of the Fatherland Day – May 7:
servicemen of the Republic of Kazakhstan who performed tasks in accordance with interstate treaties and agreements to strengthen the protection of the border of the Commonwealth of Independent States on the Tajik-Afghan section in the period from September 1992 to February 2001;
servicemen of the Republic of Kazakhstan who participated as peacekeepers in the international peacekeeping operation in Iraq in the period from August 2003 to October 2008;
military personnel, as well as officers and enlisted personnel of the internal affairs and state security bodies of the former USSR, who participated in the settlement of the interethnic conflict in Nagorno-Karabakh from 1986 to 1991;
4) Victory Day – May 9:
veterans of the Great Patriotic War;
persons equated by benefits to the participants of the Great Patriotic War;
veterans of labor;
to other persons who are subject to the Law of the Republic of Kazakhstan "On Veterans", defined by Article 8 of the Law of the Republic of Kazakhstan "On Veterans";
5) on the Day of the State Symbols of the Republic of Kazakhstan – June 4:
children with a disease caused by the human immunodeficiency virus;
persons with tuberculosis during outpatient treatment;
persons with disabilities of group 1 who have an individual rehabilitation program for sanatorium treatment, who have chosen a ticket for sanatorium treatment through the social services portal, or in accordance with the legislation of the Republic of Kazakhstan on public procurement;
6) on the Day of the Capital – July 6:
mothers with many children, awarded with "Altyn Alka", "Kumis alka" pendants or who previously received the title of "Mother Heroine", as well as awarded with the orders of "Maternal Glory" of the first and second degree;
to large families with four or more minor children living together, including children studying full-time in organizations of secondary, technical and vocational, post-secondary education, higher educational institutions, after they reach adulthood until the time they graduate from educational institutions (but not more than until they reach the age of twenty-three);
7) on the Constitution Day of the Republic of Kazakhstan – August 30:
children with a disease caused by the human immunodeficiency virus;
persons with tuberculosis during outpatient treatment;
persons with disabilities of group 1 who have an individual rehabilitation program for sanatorium treatment, who have chosen a ticket for sanatorium treatment through the social services portal, or in accordance with the legislation of the Republic of Kazakhstan on public procurement;
8) on the Day of the Elderly – October 1:
persons who have reached seventy-five years and older;
9) on the Day of the Republic – October 25:
persons with disabilities;
children with disabilities;
persons with disabilities of group 1 who have an individual rehabilitation program for sanatorium treatment, who have chosen a ticket for sanatorium treatment through the social services portal, or in accordance with the legislation of the Republic of Kazakhstan on public procurement;
children from large families who are brought up and studying in preschool organizations;
10) Independence Day – December 16:
persons who took part in the events of December 17-18, 1986 in Kazakhstan, rehabilitated in accordance with the procedure established by the Law of the Republic of Kazakhstan "On rehabilitation of victims of mass political repression";
children with a disease caused by the human immunodeficiency virus;
persons with tuberculosis during outpatient treatment.";
The maximum amount of social assistance provided in case of damage to a citizen (family) or his property as a result of a natural disaster or fire is one hundred monthly calculation indices.
The maximum amount of social assistance provided on the grounds provided for by the legislation of the Republic of Kazakhstan in the presence of a socially significant disease is ten monthly calculation indices.
