Assignment Title: Project Implementation Unit Lawyer

Reference No. (as per Procurement Plan): KZEMP/PMU-IC-29

The Ministry of Science and Higher Education of the Republic of Kazakhstan (hereinafter – the MoSHE RK), in accordance with the Loan Agreement (hereinafter – the LA) between the Republic of Kazakhstan and the International Bank for Reconstruction and Development, ratified by the Law of the Republic of Kazakhstan dated June 13, 2018 No. 157-VI, implements the “Education Modernization Project” (hereinafter - the Project), the objective of which is to improve the quality of secondary education, increase access and achieve equity in education.

The MoSHE RK intends to apply part of the proceeds for consulting services of Project Implementation Unit Lawyer.

Scope of Services:

Project Implementation Unit Lawyer (hereinafter - PMU Lawyer) will provide legal support to the MoSHE RK (i) within the framework of the Project, and (ii) in accordance with the LA, World Bank’s Guidelines on Selection and Employment of Consultants under IBRD Loans and IDA Credits and Grants by World Bank Borrowers dated January 2011 and revised July 2014 (Consultant Guidelines), Project Appraisal Document, Project Operations Manual and RoK’s current legislation.

 

The responsibilities of the Legal Specialist include, but are not limited to, the following:

 

  • Provide legal advice to the MoSHE RK and PMU during Project implementation.
  • Draft and negotiate contracts.
  • Draft legal memoranda, contracts and other legal documents.
  • • Conducting negotiations on legal issues with representatives of the Consultants, MoSHE RK, IBRD and other stakeholders of the Project.
  • Analyze legal and policy instruments.
  • Conduct legal research.
  • Liaise with stakeholders within the MoSHE RK, the PMU, Bank and regulatory authorities, as appropriate.
  • Provide legal advice to address potential disputes and claims related to the Project.
  • Provide information on legal issues to regulatory authorities, as applicable.
  • Coordinate with the procurement specialist to ensure contracts for the performance of works, goods, services are properly administered and monitored.

 

Duration of the assignment is until June 30, 2024, with a trial period of three months. Subject to changes and additions to the terms of reference in agreement with the MoE RK and the World Bank.

 

The Ministry of Science and Higher Education of the Republic of Kazakhstan invites individual consultants to indicate their interest in providing the above services. Interested individual consultants should provide information demonstrating that they have the required qualifications and relevant experience to perform the Services.

Qualification requirements:

  • Higher education degree in the field of jurisprudence, international law; Master's degree, Ph.D. and/or presence of international certificates is an advantage.
  • At least 5 years of relevant professional work experience, in government, private sector, and/or non-governmental organizations is mandatory, including contract law and litigation.
  • Work experience in international projects and with international organizations is an advantage.
  • Strong knowledge of national and international law required.
  • Strong written and verbal communication skills required.
  • Fluency in Kazakh and Russian languages, and professional knowledge of English are mandatory.

 

Individual Consultant will be selected in accordance with the procedures set out in the World Bank’s Guidelines: Selection and Employment of Consultants by World Bank Borrowers under IBRD loans and IDA Credits and Grants of January 2011 revised on July 2014 (hereinafter – Consultant Guidelines).

The attention of interested Consultants is drawn to paragraph 1.9 of the Consultant Guidelines, setting forth the World Bank’s policy on conflict of interest.
