The Department of Control in the Public Service carried out an analysis of the results of unscheduled inspections for compliance with the civil service law with regard to the restored rights of citizens who applied for the protection of their rights, as well as monitoring the performance of submissions made to state bodies on the results of inspections on public service issues and proposals for cancellation of decisions , adopted in violation of the law. Thus, for the 1st quarter of 2018, the Agency and its territorial departments conducted 302 inspections (7 inspections by the Agency and 295 - by territorial departments). The basis for inspections were the appeals of natural persons (171), legal entities (53), civil servants' appeals (41), spot checks (34), instructions of prosecutors and prosecution authorities (2), and 1 audit conducted on other grounds (service notes of employees of the territorial departments of the Agency, critical publications in the media, etc.). Based on the results of the inspections, 3170 violations of the legislation in the civil service and professional ethics were revealed, including 883 (27.8%) cases of violations of annual assessment of civil servants; 448 (14.1%) cases of violations of competitive procedures for the employment of vacant administrative civil service positions; 242 (7.6%) cases of violations of Certification of civil servants; to provide compensation for processing there are 201 (6.3%) cases of violation; 171 (5.3%) cases of violations of the procedure for attracting civil servants to disciplinary liability 171 (5.3%); 144 (4.5%) cases of violation of the Code of Ethics; the cases of violation of other requirements of legislation in the sphere of civil service are 1081. During the analysis of violations, the following has been established.
Regarding the annual assessment of civil servants
The analysis found that the greatest proportion of such violations occur in the Aktyubinsk (615) and Almaty (161) areas. For reference: 48 violations in Kostanay, 26 – in West Kazakhstan, 16 – in Karaganda region, 11 – in Astana, 3 – in Zhambyl, 2 – in Atyrau, 1 – in East Kazakhstan regions. In other regions such violations are not available.
Concerning the violations of the competitive procedures. 448 violations of the order for holding competitive procedures for occupying vacant administrative positions were revealed (123 - in Pavlodar, 70 – in Kyzylorda, 63 – in Akmola, 51 - in Aktobe , 30 – in West Kazakhstan, 25 – in East Kazakhstan regions, 24 – in Astana, 19- in Karaganda, 14 – in Kostanay, 8 – in Mangistaus, 7 – in Zhambyl, 4 – in Atyrau, 2 – in South Kazakhstan, 1 fact of violation in each Almaty region and Astana city. Factual violations have not been detected in the North Kazakhstan region.
Regarding the attestation of civil servants. The largest number of violations committed in the attestation of civil servants was identified by the departments of the Agency for Aktobe (95), Karaganda (70) and West Kazakhstan (68) regions. The departments for Kostanay and Almaty regions revealed 8 and 1 violations respectively, other departments did not establish violations in this direction.
Concerning the provision of compensation for processing. Violations were revealed only in Pavlodar (153) and Atyrau (48) regions.
Concerning violations of the order of bringing to disciplinary responsibility. The main number of violations of the order of bringing to disciplinary responsibility falls on Akmola (34), West Kazakhstan (28), Karaganda (27) and Kostanay (21) regions. Reference: Zhambyl (13), Almaty (9), Aktobe, Mangistau and North Kazakhstan (6 each), Kyzylorda (5), Pavlodar and South Kazakhstan (4 each), Atyrau and East Kazakhstan regions (3 each), Astana city (2). In Almaty, there are no such violations.
Regarding non-compliance with the requirements of the Code of Ethics
During the reporting period, the norms of official ethics were violated by employees of the East Kazakhstan region 29 times, in North Kazakhstan – 20times, in Karaganda – 19 times, in Atyrau -14 times, in Aktobe -11 times, in Pavlodar -10 times, in Akmol region – 9 times, in Western Kazakhstan region - 7 times, in Almaty region and Astana city – 6 times, in Kostanay region - 5 times, in Mangistau – 3 times, in Zhambyl and South-Kazakhstan regions – 2 times each. Once the ethical code was violated by the employee of the central state body. In Almaty and Kyzylorda region, employees didn’t violate the official ethics.
Regarding submissions and proposals made on the results of audits. In the reporting period, following the results of inspections, 160 submissions and proposals were made to state bodies to cancel decisions taken in violation of the law, of which 146 were executed (91.3%), including the cancellation of 15 illegally accepted acts (on imposing penalties - 7, in violation of the Rules for holding the competition 4 orders, when promoting the civil servants -1 act, and also 3 other acts of state bodies were canceled) and 15 decisions of state bodies (competition commissions - 11, disciplinary commissions - 1 and 3 - of other decisions). Execution of the remaining 14 submissions and proposals for the cancellation of acts is planned for the next quarter. In the first quarter of this year, 157 citizens applied to the public service and anti-corruption bodies for the protection of their rights. As a result of unscheduled inspections, the rights of 97 authors of appeals (61.7%) were restored, which exceeds the indicator set in the Agency's Strategic Plan (46%). As a result of the measures taken by the Agency and its territorial departments, 174 state employees were brought to disciplinary responsibility (including 2 lowered in office, 7 - for incomplete official correspondence, 7 employees were made severe reprimands, 62 - reprimands, 85 employees were made remarks), of them for committing offenses that discredit the state service, 2 civil servants have been warned about incomplete service compliance, 37 employees for violation of the norms of service ethics (2 employees are demoted, 5 - are warned of incomplete service , strict reprimands were imposed on 2 employees, 16 employees were made reprimands, 12 employees were made remarks).
