On the participation of Deputy Prosecutor General M. Akhmetzhanov at the IV Congress of Entrepreneurs

June 14, 2017, Astana city. Deputy Prosecutor General of Kazakhstan Marat Akhmetzhanov took part in the Congress of NCE "Atameken" and talked about measures being taken to protect business in the criminal process.

Approaches to the initiation of economic crimes are changed. They are registered only in the presence of acts of checks and damage. As a result, economic crimes decreased by 4 times.

Amendments have been made to Articles of the Criminal Code related to the humanization of criminal offenses in the economic sphere, where the key innovation is the decriminalization of pseudo-entrepreneurship (Article 215 of the Criminal Code). Also, under 13 Articles of the Criminal Code, the amount of punishment is reduced, 6 Articles provide for the exemption from responsibility of persons who have committed a crime for the first time, for 3 serious Articles are introduced alternative punishment in the form of multiple fines.

By reducing criminal repression, conditions will be created for normal tax administration. A full transition to a risk-based system of inspections will not allow checking everyone in a row, but will be selection with clear criteria.

"For example, huge turnover, a lot of supplies, and workers, equipment, even the company has no office. There is just a signal in the system. Declarations are often corrected. Documents are changing. Also it is a signal. You'll fall into the red zone - wait for the check. KGD will also introduce the best world experience. New technologies. Electronic invoices, non-cash payments, deposit VAT-accounts. All this will make operations transparent and lawful, " the representative of the General Prosecutor’s  Office Marat Akhmetzhanov said in his speech.

Also, Marat Akhmetzhanov emphasized that decriminalization of pseudo business would not entail negative consequences, since criminal liability for tax evasion remains. The main emphasis will be placed on those who work in bad faith.

At the end of the speech, he urged business representatives to jointly create an atmosphere of intolerance towards the shadow economy, create conscientious competition based on competition and entrepreneurial spirit.

It will be recalled that, in conjunction with interested government agencies, NCE "Atameken" is implementing the road map approved by the Forum on June 14, 2016. The project provides good opportunities for joint solution of problematic issues.

At the Forum they discussed the outcome of the work of the Chamber and outlined the priority tasks for the forthcoming period, the problematic issues of business development.
