Alimony payment is the duty of every parent

Protection of the life and health of minors is the most important factor in maintaining the stability of the demographic state of the state.

A significant role in solving the assigned tasks is also assigned to the prosecutor's office, in whose activity one of the priority areas is the supervision of the application of laws on minors.

On October 4, 2016, the General Prosecutor's Office presented the project "Alimony. 30 steps against non-payment. "

As part of the implementation of this project, in addition to the prosecutor's office of the Kostanay region, the Department for the Execution of Judicial Acts, the Department of Internal Affairs Bodies, and Social Protection Bodies are involved.

During the period of the project, as a result of the measures taken, the arrears of alimony in the amount of over 101 million tenge for 2,358 children were repaid.

As part of the project, lists of hard-core debtors were drawn up who did not have the opportunity to pay alimony on time. Together with the employment department, work is being carried out on their employment.

A total of 280 debtors were employed, 172 debtors were registered as unemployed.

As a result of the intensification of actions aimed at fulfilling the principle of inevitability of punishment, 250 debtors were brought to administrative responsibility.

In order to properly execute the project, the regional prosecutor's office has developed an algorithm of actions to bring hard-core non-payers to criminal liability under Article 139 of the Criminal Code.

So, in case of refusal of the debtor from the proposed work, this circumstance was regarded as malicious evasion from the payment of alimony, and the issue of bringing the debtor to criminal liability was decided.

Since the implementation of the project, 6 hard-core debtors have been convicted, criminal cases against 34 debtors have been terminated under an amnesty.

For example, by the decision of the specialized interdistrict juvenile court, citizen A. was deprived of her parental rights in relation to her daughter, and alimony was collected from her.

During the trial, it was established that she did not pay alimony since the deprivation of her parental rights.

At the same time, she was repeatedly warned about administrative and criminal liability for failure to comply with a court decision.

In addition, citizen A., working at the PKKK in Lisakovsk from April to June 2016 and receiving a salary in the amount of 98,889 tenge, knowing that there was a debt in the amount of 426,219 tenge, did not take measures to pay off the existing alimony debt.

By the court, citizen A. was found guilty of committing a crime under Article 139 of the Criminal Code of the Republic of Kazakhstan and she was sentenced to 1 year of restriction of freedom. The verdict of the court entered into legal force.
