According to the report “On work about execution of judicial acts” as of November 1 of this year, bailiffs had 254,660 enforcement proceedings for the recovery of alimony in the amount of 17,244,570,536 tenge, of which only 2,426,519,642 tenge or 14% was recovered.
On the website of the Committee on Legal Statistics and Special Accounts qamqor.gov.kz there is a service for searching for alimony debtors, where almost one and a half thousand wanted persons are placed on 59 pages.
Among those to whom they are owed, mostly their minor children, elderly parents, spouses, occasionally brothers or sisters or guardianship authorities.
By November 1 of this year, only 38,154 cases were executed by bailiffs, property was converted, and payments were started. However, most of them, which is 216,506 productions, still remain unfulfilled. It should be noted that the alimony payers themselves are not in a hurry to fulfill their obligations, while the bailiffs are slow to implement them.
The analysis showed that only 49% of enforcement cases are put on periodic execution, i.e. payments are made to the recoverer.
Selective verification of the tenth part of the outstanding 216 thousand proceedings established the following facts:
- more than 9 thousand debtors on alimony have permanent pension contributions, which means that they have a stable income and can pay alimony, but bailiffs do not perform proper work;
- more than 2.6 thousand debtors have real estate or vehicles, but the bailiffs did not take measures to foreclose on the property;
- more than 3 thousand debtors on alimony are not put on the wanted list;
- 515 debtors have not taken measures to restrict their departure.
To collect alimony, the Committee sent an information letter to the Republican Chamber of Private Bailiffs.
