This made it possible to prevent illegal interference of state bodies in business activities. in just 10 months of this year, the Committee on legal statistics and special accounts (hereinafter referred to as the Committee) and its territorial bodies refused to register 170 inspections, 52 of them under the moratorium on inspections of small businesses.

From January 1, 2020, the decree of the President of the Republic of Kazakhstan introduced a 3-year moratorium on inspections of small businesses and microenterprises.

Exceptions are only checks aimed at preventing or eliminating violations that potentially pose a massive threat to the life and health of the population, the environment, the rule of law and public order, or a direct or immediate threat to the constitutional order and national security.

These checks should be carried out only by the decision of the first head of the Central state or local Executive body with mandatory registration in the bodies of legal statistics and special accounting. If the audit does not meet these requirements, the Committee will prevent unjustified interference with the business at the registration stage.

So, despite the ban established by the moratorium, the sanitary control authorities of the Alatau district of Almaty were appointed to check the activities of "Zhan bope" LLP. According to the Register of business entities, this LLP belongs to the microenterprise entity and falls under the moratorium. The Committee had issued a refusal of registration of the inspection.

Another unsubstantiated check was tried by the bodies Of the Department of the Committee for industrial development and industrial safety of Almaty in relation to "EMARAT" LLP. Officials of state bodies were brought to administrative responsibility under article 175 of the administrative Code of the Republic of Kazakhstan for violations of the procedure for conducting inspections during the moratorium.
