On approval of the Rules for the appointment and payment of State targeted social assistance

In accordance with paragraph 4 of Article 7 of the Law of the Republic of Kazakhstan "On State targeted social assistance", I ORDER:

Approve the attached Rules for the Appointment and Payment of State Targeted Social Assistance.

The Department of Social Assistance of the Ministry of Health and Social Development of the Republic of Kazakhstan in accordance with the procedure established by law to provide:
1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;
2) within ten calendar days after the state registration of this order in the Ministry of Justice of the Republic of Kazakhstan, a referral for official publication in periodicals and the information and legal system of regulatory legal acts of the Republic of Kazakhstan "Adilet";
3) placement of this order on the Internet resource of the Ministry of Health and Social Development of the Republic of Kazakhstan;
4) bringing this order to the departments of coordination of employment and social programs of the regions, the cities of Astana and Almaty.
Control over the execution of this order should be entrusted to the Vice-Minister of Health and Social Development of the Republic of Kazakhstan S.K. Zhakupova.
This order shall enter into force upon the expiration of ten calendar days after the date of its first official publication.

Rules for the appointment and payment of state targeted social assistance

Chapter 1. General provisions
These Rules for the Appointment and Payment of State targeted social assistance and the provision of a Guaranteed social package (hereinafter referred to as the Rules) are developed in accordance with paragraph 4 of Article 7 of the Law of the Republic of Kazakhstan "On State Targeted Social Assistance" (hereinafter referred to as the Law) and determine the procedure for the appointment and payment of state targeted social assistance and the provision of a guaranteed social package.

The following basic concepts are used in these Rules:
1) an individual plan of assistance to a person (family) (hereinafter referred to as an individual plan) is a plan of measures to promote employment and (or) social adaptation drawn up by the employment center together with the person who applied for state targeted social assistance and (or) his family members;
2) The State Corporation "Government for Citizens" (hereinafter – the State Corporation) – a legal entity established by the decision of the Government of the Republic of Kazakhstan to provide public services, services for issuing technical specifications for connection to the networks of natural monopoly entities and services of quasi-public sector entities in accordance with the legislation of the Republic of Kazakhstan, organization of work on accepting applications for the provision of public services, services for issuing technical specifications for connection to the networks of natural monopoly entities, services of quasi-public sector entities and the issuance of their results to the service recipient on the principle of "one window", as well as ensuring the provision of public services in electronic form, carrying out state registration of rights to immovable property at its location;
3) assistant – an employee of the Employment Center who performs the functions of assisting a social work consultant and the mayor of a village, village, rural district in conducting consultations, interviews, as well as monitoring the fulfillment of obligations under a social contract;
4) authorized organization for the payment of state targeted social assistance and monthly additional payments for each child aged one to six years inclusive – organizations licensed by the authorized body for regulation and supervision of the financial market and financial organizations for the relevant types of banking transactions, or territorial divisions of the joint-stock company "Kazpost";
5) measures of social adaptation – a set of measures, including measures of social rehabilitation of persons with disabilities, defined by Article 21 of the Law of the Republic of Kazakhstan "On Social protection of persons with disabilities in the Republic of Kazakhstan", special social services provided to persons in difficult life situations, in accordance with the Law of the Republic of Kazakhstan "On Special social services", as well as other measures of state support provided in accordance with the procedure provided for by the legislation of the Republic of Kazakhstan;
6) social maladaptation – violation of the interaction of a person with the social environment;
7) social deprivation – restriction and (or) deprivation of the possibility of self-satisfaction by a person (family) of basic life needs;
8) a social work consultant (hereinafter referred to as a consultant) is an employee of the Employment Center of the population who assists in the appointment of state targeted social assistance and the exit of a low–income person (family) from a situation caused by his (their) being below the poverty line;
9) social contract – an agreement defining the rights and obligations of the parties on participation in active measures to promote employment between a citizen of the Republic of Kazakhstan or a candace from among the unemployed, certain categories of employed persons determined by the Government of the Republic of Kazakhstan, as well as other persons in cases provided for by the Law of the Republic of Kazakhstan "On Employment" (hereinafter – The Law on Employment of the Population), and the employment center of the population, and in cases provided for by the Law on Employment of the Population, with individuals and legal entities involved in the organization of active measures to promote employment, as well as on the provision of state targeted social assistance;
10) Unified Contact Center - a legal entity designated by the Government of the Republic of Kazakhstan, performing the functions of an information and reference service for providing information to service recipients on the provision of state and other services, as well as information to state bodies on the provision of information and communication services;
11) able–bodied person (able-bodied family member) - a person or family member aged from sixteen years to the age provided for in paragraph 1 of Article 11 of the Law of the Republic of Kazakhstan "On Pension Provision in the Republic of Kazakhstan", with the exception of persons with disabilities of the first or second group and (or) persons with diseases in which the term of temporary disability of more than two months is established;
12) average per capita income – the share of total family income per family member per month;
13) total income – the sum of the types of income taken into account when assigning state targeted social assistance;
14) the standard list of measures to promote employment and social adaptation (hereinafter referred to as the Standard List) is a list of active measures to promote employment and social adaptation approved by the central executive body in the field of social protection of the population, and recommended for use when concluding a social contract;
15) service provider – local executive body of cities of republican significance and the capital, districts and cities of regional and district significance;
16) low–income persons (families) - persons (families) with average per capita income per month below the poverty line established in regions, cities of republican significance, the capital;
17) authorized body – the local executive body of the city of republican significance, the capital, the district, the city of regional significance, the district in the city, the city of district significance, carrying out the appointment of state targeted social assistance (hereinafter – the authorized body);
