A representative of the Karaganda Region Commissioner for Human Rights assisted in the restoration of the violated rights of a convicted citizen

         A representative of the Commissioner for Human Rights in Karaganda region in the course of media monitoring on May 2 of this year in the social network "Facebook" established the publication of the user "Kuresker.org" about the facts of torture, other cruel, inhuman and degrading treatment and punishment in respect of convict V. Niyaztaev, serving his sentence in facility №33 of Penitentiary Institution №33 in Karaganda region and region №4B0↩alytau).

         On May 3 of this year the representative visited institution №33 and personally met with inmate V. Niyaztayev.

         During the reception the convicted Niyaztayev V.Kh. informed about unlawful actions of employees of this institution, which expressed in physical and moral pressure (torture, beatings, humiliation, threats, etc.). In this connection the applicant asked to take appropriate measures against the employees and ensure his personal safety by transferring him to a safe place.

         In this regard, the Representative examined the convicted person for bodily injuries (no visible signs of physical abuse were found), and the convicted Niyaztayev V.Kh. was recommended to draw up a written statement, which was subsequently sent to the National Human Rights Center through the IS "Documentologist".

         As part of consideration of this appeal, a request was sent to the specialized prosecutor's office for supervision over the legality of execution of criminal punishments in institutions of Karaganda region to check all the circumstances to be clarified and to take prosecutorial oversight measures provided for by law.

After the receipt of the request, on 3 May this year the specialized prosecutor's office registered this fact in the PMC and sent it to the Investigative Department of the Karaganda region for the adoption of the procedural decision.

         Moreover, on the same day the convicted Niyaztayev V. Kh. in order to ensure his personal safety was transferred to a safe place in accordance with the requirements of article 12 of the Penal Enforcement Code.
According to the results of measures of prompt response of the Representative of the Commissioner for Human Rights in the Karaganda region, measures aimed at protection of the rights of the convicted person serving his sentence in the institution of the penitentiary system were taken.
