With the assistance of the Representative of the Commissioner for Human Rights in the Atyrau region stopped the violation of human rights

         A person under investigation appealed to the representative of the Commissioner for Human Rights in Atyrau region with a request to receive him in the institution because of violations of his rights during the investigative actions. A representative of the Commissioner for Human Rights in the Atyrau region (hereinafter - the Representative) Abildaev A.S. held a personal reception of the person under investigation in the detention facility.

         During the conversation the applicant informed that he disagreed with qualification of his acts as robbery, because his crime falls under the signs of robbery.

         At the reception the documents on the case submitted were examined. According to the documents submitted by the applicant, the punishment was seven years' imprisonment

         Taking into account the circumstances that the criminal case was already in court in accordance with the requirements of Part 3 of Article 305 of the CCP of Kazakhstan, the arguments stated by the applicant were sent to the court.

         Having analysed the meeting with the applicant, the Representative decided to take part in the hearing of the criminal case in Atyrau City Court No. 2 as an observer.

         As a result, Atyrau City Court No. 2 imposed a sentence of five years' probation.

         With the assistance of the Representative of the Commissioner for Human Rights in the Atyrau region the violation of human rights in the Atyrau region was stopped, the convicted person received a punishment which was commensurate with the act. The sentence came into legal force.
