In the first quarter of 2023 there were 1,236 appeals, so in one day there are more than 20 applications. Compared with the same period last year, the increase in the number of complaints is about 60% (I quarter 2022 - 731).
The predominant number of appeals were received electronically via e-Otinish (77%).
The content of applications is diversified, most of them refer to actions (inaction) of law enforcement agencies - 21% and to disagreement with judicial acts - 26%.
Complaints about violation of rights to work, health care, housing rights, social security, minors, persons with disabilities, etc. were registered.
During this period, of the total number of appeals (1,236), 6.3 percent (78) were positively satisfied, explanations were given for 46 percent (569) of the appeals, and the rest are in progress.
One example of a positive review is the appeal of M. on the actions of the management of a legal entity in terms of violations of labor laws.
After the National Center's intervention the state labor inspector conducted an unscheduled inspection in the organization, the result of which was a protocol on an administrative offense and on February 21, 2023 the employer paid the applicant's salary and vacation pay.
Quite often there are appeals against court decisions. For example, Mr. I. filed a complaint against a guilty verdict that had entered into force. In the course of examination it was established that the General Prosecutor had lodged an appeal against the verdict, which had been rejected by the Supreme Court. Thus, the applicant exhausted all legal remedies to appeal against the judicial act. Therefore, the applicant was informed about the inadmissibility of interference with the administration of justice.
For the organization of assistance in filing appeals, the National Center has developed a corresponding video instruction, the link https://www.gov.kz/memleket/entities/ombudsman/press/media/details.
In addition, citizens ask for personal reception. In Q1, A. E. Lastayev held 30 appointments with the UHRO and 43 with the NCHR leadership.
We note that in order to respond promptly to human rights violations, since October 2022 Representatives of the Ombudsman work in the regions, to whom applicants can file a complaint and make an appointment to see them. Contact information for the Representatives can be found at https://www.gov.kz/memleket/entities/ombudsman/about/structure.
