The Senate adopted the law «On amnesty in connection with the 30th anniversary of independence of Kazakhstan». It is expected that about a thousand people will be released.
According to Interior Minister Yerlan Turgumbayev, according to some articles of the Criminal Code, the unserved part of the sentence will be reduced to convicts or they will be removed from probation records, and criminal proceedings of minor gravity will be discontinued.
«The draft law was developed according to the instruction of the Head of State. The bill is aimed at exemption from serving sentences for crimes of small and medium gravity, as well as reducing the unserved sentence for serious and especially serious crimes. Special attention is paid to socially vulnerable categories of citizens - veterans, minors, elderly citizens, disabled people of groups I-II, and other persons who do not pose a serious threat to the security of citizens and the state. A separate article of the bill specifies the list of persons who have committed crimes to which the amnesty will not apply», the minister said at a Senate meeting.
According to him, more than 34 thousand people are held in 80 penal institutions (64 colonies and 16 pre-trial detention centers). At the same time, 93 percent are serving sentences for serious and especially serious crimes, and about 45 percent have already been brought to criminal responsibility. 32 thousand people are registered with the probation service in the country.
«According to preliminary calculations, over 14 thousand people will fall under the amnesty, about one thousand people will be released from correctional institutions, 3.8 thousand people will be removed from the probation services. A differentiated reduction of the unserved sentence will be applied to 9 thousand convicts. Thirdly, at the same time, more than 5 thousand criminal cases under the amnesty will be reduced. According to them, 1.6 thousand persons will be released from criminal liability by the decision of the investigative authorities, the courts will apply the norms of shortening the sentence and release to the rest of the persons», Turgumbayev added.
Convicted persons who have committed terrorist and extremist crimes will not be able to count on amnesty.
The law will be sent to the President for signature. The amnesty will be applied within 6 months from the date of its entry into force. In addition, the law stipulates that the government and akimats will provide social assistance to the amnestied, including employment and treatment. As Senate Speaker Maulen Ashimbayev stressed, this will be the ninth amnesty in the history of Kazakhstan's independence.
