The Ministry of trade has made changes to the Rules of internal trade in terms of the sale of alcohol and tobacco products
On August 19, 2020, the Ministry of trade and integration amended the order of the acting Minister of national economy of the Republic of Kazakhstan dated March 27, 2015 No. 264 "on approval of internal trade Rules".
Thus, according to article 110 Of the code of the Republic of Kazakhstan on the health of the people and the health system, persons who sell alcoholic products and tobacco products, including products with heated tobacco, hookah tobacco, hookah mix, systems for heating tobacco, electronic consumption systems and liquids for them, must:
1) require the presentation of an identity document;
2) refuse to sell tobacco products, including products with heated tobacco, hookah tobacco, hookah mix, systems for heating tobacco, electronic consumption systems and liquids for them, if an identity document has not been presented.
After the adoption of the new Code, complaints from citizens increased due to the need for all buyers, without exception, to present identity documents when purchasing alcohol and tobacco products. That is, according to the Code, all buyers are required to present identity documents to determine the seller's age. If the age of the buyer after checking the document is older than 21 years, only in this case the seller sells the product.
However, according to the old Code, which has lost its force, when selling alcohol and tobacco products to citizens whose age, judging by their appearance, is less than 18 years, persons engaged in the sale of alcohol and tobacco products were obliged to:
1) require the presentation of an identity document in order to determine the actual age of the buyer;
2) refuse to sell tobacco products if an identity document has not been presented.
In this regard, the Commerce Department initiated modification of the order of the acting Minister of national economy R cat 27 Mar 2015 No. 264 "On approval of internal trade" in terms of presentation, paragraph 50 as follows:
"The seller is engaged in the retail trade sells the goods to everyone who will apply for the purchase of goods, except for cases when legislation of the Republic of Kazakhstan in the field of public health and health systems, safety of machines and equipment, as well as the safety of food products has a limit.
Seller of alcoholic beverages and (or) tobacco products, including products with heated tobacco, hookah tobacco, hookah mix, systems for heating tobacco, electronic consumption systems and liquids for them, if there is doubt that the buyer has reached the age of twenty-one:
1) requires the presentation of an identity document (including an identity document of a foreign citizen);
2) refuse to sell alcoholic beverages and (or) tobacco products, including products with heated tobacco, hookah tobacco, hookah mix, systems for heating tobacco, electronic consumption systems and liquids for them, if an identity document (including an identity document of a foreign citizen) has not been presented.".
This change allows the seller to require an identity document when selling alcohol and tobacco products only if the seller has doubts about the buyer reaching the age of 21.
