The Committee for Technical Regulation and Metrology has identified numerous cases of the use of "non-standard " measuring devices in educational and medical institutions, in industrial production and in testing laboratories. Violations of conformity assessment procedures were detected during the certification of personal protective equipment, auto chemicals and other industrial goods.
Thus, during the unscheduled inspections, the departments found violations in state educational institutions - MI (measuring instruments - tonometer, scales, height meter, thermometer) were used failed verification, which is a violation of Article 19 of the Law of the Republic of Kazakhstan "On ensuring the uniformity of measurements".
Also, MI (a device for measuring blood pressure, a dispenser, a biochemical automatic analyzer, non-contact infrared thermometers) were used in medical centers that did not pass verification, which is a violation of Article 19 of the Law of the Republic of Kazakhstan "On ensuring the uniformity of measurements".
The use of such measuring instruments without verification can lead to unreliable measurement results and incorrect diagnosis of the disease.
Such violations were detected at the production site, for example, non-compliance of products with the requirements of the technical regulation of the Customs Union 022/2011 "Labeling of food products" in terms of labeling.
Violations of conformity assessment procedures were also revealed during the certification of personal protective equipment, auto chemicals and other industrial goods.
At the same time, there are examples of violations by accreditation subjects:
- product tests are not carried out in full;
- the actual results obtained during the tests are not given;
- the full location of the manufacturer is not indicated.
- some applicable GOST standards are not available in the field of accreditation of the Testing Center in the column "Designation of regulatory documents for test methods for determining characteristics (indicators)".
- the HS codes that are not present in the column "Code of the commodity nomenclature of foreign economic activity of the Eurasian Economic Union" of the scope of accreditation of the Conformity Assessment Body are applied;
- GOST standards that are not valid on the territory of the Republic of Kazakhstan are applied.
These facts are a violation of paragraphs 1) and 2) of paragraph 5 of Article 8 of the Law of the Republic of Kazakhstan "On accreditation in the field of conformity assessment" and may lead to the issuance of gray documents confirming compliance for products that do not meet the safety requirements of technical regulations.
The Committee brought to responsibility the sellers for the sale of products that do not meet the requirements of the technical regulations, namely the coolant. These facts are a violation of Article 35 of the Law "On Technical Regulation". Measures are also taken against manufacturers and importers of these products.
Products that do not meet the requirements of technical regulations
pose a potential threat to the life and health of citizens of the Republic of Kazakhstan.
For 6 months of 2021, the Departments of the Committee for Technical Regulation and Metrology of the Ministry of Trade and Integration of the Republic of Kazakhstan conducted 191 inspections, of which 85 were unscheduled inspections, 83 were preventive control with visits, 21 were joint inspections with other state bodies.
In total, violations were detected in 109 objects, including 25 for unscheduled inspections, 70 for preventive control with visits, 14 joint inspections with other state bodies.
91 orders were issued and fines were imposed in the amount of 34,551,555 tenge.
In the course of the work, 104 certificates and declarations of conformity were canceled (canceled by order, due to violations of technical regulations) issued by the EAEU member states, due to identified inconsistencies with the requirements of the technical regulations of the Customs Union.
At the same time, 5 "gray" certificates (fake) were identified, the validity of which was also canceled.
The Committee has strengthened its work on product safety and the new version of the Law" On Technical Regulation " of December 30, 2020 introduces a new mechanism for monitoring and supervising products, which will be carried out with the selection of samples and referral for laboratory tests.
According to the results of research, in case of detection of non-compliance of products with the requirements of technical regulations, rapid response measures will be taken in the form of a ban on their release into circulation, and in relation to dangerous products, their withdrawal, with the deprivation of the right of ownership and its further destruction through the court.
Also, the new law" On Technical Regulation " provides for the improvement of the Unified Information System of Technical Regulation (electronic database) for the rapid exchange and traceability of information on imported products (volumes, data on foreign trade participants, information on the passage of conformity assessment, etc.), notifying consumers about detected dangerous products.
The provision of data and the exchange of information about products will be carried out via the Internet with limited access for the population and the possibility of wider access for authorized state and regulatory bodies (state revenue bodies, sanitary and epidemiological control, technical regulation, agriculture, etc.), thereby putting a barrier to gray imports, gray certification.
