Regarding the payment of anti-dumping duty on cast aluminum disks equipped with tires and imported from China

In connection with the incoming appeals regarding the payment of anti-dumping duty on cast aluminum disks (hereinafter – aluminum disks) equipped with tires and imported from China, we explain the following.

The decision of the Board of the Eurasian Economic Commission №43 of March 26, 2019 introduced an anti-dumping measure against aluminum disks originating in China. This measure is valid from 28 April, 2019 to April 27, 2024. The anti-dumping duty rate is 33,69% of the customs value.

When importing aluminum disks on which tire is mounted (ready-made wheels), the anti-dumping duty is not paid. In turn, aluminum disks in their «pure» form (i.e. outside the machine kit and without a mounted tire) are subject to anti-dumping duty, regardless of whether they are intended for industry assembly of motor vehicles or for the spare parts market.

Please note that the anti-dumping duty is levied only on those aluminum disks that correspond to the product scope of the anti-dumping measure. For example, when importing aluminum disks with a maximum permissible load of 1200 kg, no anti-dumping duty is charged.

For reference: Cast aluminum disks, which are running wheels made of aluminum with a diameter of 13 to 20 inches inclusive, with a maximum permissible load of no more than 1150 kg, with a diameter of central hole up to 131 mm inclusive, classified by EAEU HS codes 8708 70 500 1 and 8708 70 500 9 fall under the product scope of the anti-dumping measure. At the same time, the EAEU HS codes are given exclusively for information.

We note that the anti-dumping measure applies only to aluminum disks originating in China. At the same time, according to paragraph 25 of the Rules for determining the origin of goods imported into the customs territory of the EAEU (approved by the decision of the Council of the Eurasian Economic Commission №49 of July 13, 2018), the origin of similar aluminum disks originating in other countries and imported into the customs territory of the EAEU must be confirmed by a certificate of origin, except for the case of confirmation of compliance with the applicable trade remedy measures, i.e. payment of anti-dumping duties.
