Decision of the Turksib court of Almaty on the claim of KZPP to Bek air

Today, October 29, 2020, the Turksib court of Almaty granted the claim of the Committee for consumer protection of the Ministry of trade and integration of the Republic of Kazakhstan (hereinafter - KZPP) to the airline "Bek air" JSC for the refund of the cost of tickets for canceled flights, in full.

KZPP represented the interests of 535 people, the amount of the claim was 33.8 million tenge.

A day earlier, the Prosecutor supported the claim of the KZPP to the airline "Bek air".

KZPP claims:
1. Recognize the right of consumers of Bek air services to refund the full cost of previously purchased tickets for flights that were canceled through no fault of the consumer;
2. Force the Respondent to refund the full cost of previously purchased tickets for flights that were canceled through no fault of the consumer;
3. Recover from JSC "Bek air" the amount paid for air tickets in favor of consumers.

Recall that this is the third claim of the KZPP to the airline. Earlier, on October 15 and 26, 2020, the appellate judicial Board for civil cases of the Almaty city court dismissed the appeals of Bek air JSC, and the decisions of the first instance court remained unchanged.
Thus, the court's decisions on the first and second claims of KZPP against Bek air entered into force. Further, the refund will be made in accordance with the Law "on enforcement proceedings and the status of bailiffs" (hereinafter - the Law), according to which the execution of court decisions by bailiffs must be completed no more than two months from the date of initiation of enforcement proceedings, with the exception of enforcement documents on periodic penalties, as well as in cases where legislative acts set other deadlines for execution (article 39 of the Law).
In connection with the daily receipt of complaints from customers of the airline "Bek air", KZPP intends to file a fourth lawsuit.

In General, the KZPP, as an authorized body, will continue to protect Kazakhstanis and assist in restoring violated consumer rights.
