On October 26, 2020, the final session of the Board of appeal for civil cases of the Almaty city court was held. The court decided to leave the decision of the court of first instance unchanged, and the appeal of JSC «Bek Air» without satisfaction. The court's decision comes into force from the moment of announcement.

Recalling you that the Committee for consumer protection (hereinafter - CСP) filed a lawsuit on July 3, 2020, in which it represented the interests of 81 consumers who bought tickets in the amount of 5.9 million tenge.

On July 24, 2020, the Turksib district court of Almaty granted the claim of the CCP, to which JSC «Bek Air» filed an appeal.

At the same time, we explain that according to article 241 of the Civil Procedure Code of the Republic of Kazakhstan, after the court decision enters into legal force enforcement the enforcement order shall be issued. The (hereinafter referred to as the writ of execution) is issued by the court of the first instance within three business days after the decision entry into legal force or the case return from a superior court.

In accordance with article 18 of the Law «On Enforcement Proceedings and the Status of Enforcement Agents» (hereinafter - the Law), individuals can participate in enforcement proceedings independently or through representatives.

Enforcement of court orders by enforcement agents must be completed no later than two months from the date of initiation of enforcement proceedings, with exception of court orders on periodic recoveries, except the cases, when were established other periods of enforcement by legislative acts (article 39 of the Law).

Additionally, the Turksib district court of Almaty is considering the third claim against  JSC «Bek Air», in which the CСP represents the interests of 535 consumers, the amount of the claim is 33.8 million tenge. The next meeting is scheduled for 15: 00 on October 28, 2020.
