Ensuring product safety, market protection through a system of technical regulation

We are daily consumers of domestic and imported products and pay attention to its quality, safety and get acquainted with information for the consumer, that is, product labeling. We often witness that the information on the label can mislead consumers about the safety and quality of products or it is not available at all, and products are sold without certificates and declarations of conformity.

In order to prevent, detect, and suppress such violations, state control and supervision in the field of technical regulation is carried out. And the products are subject to state control and supervision, in respect of which technical regulations have been put into effect. To date, 49 Technical Regulations and 24 of the Republic of Kazakhstan have been put into effect within the framework of the Eurasian Economic Union.

On July 1, 2021, the Law of the Republic of Kazakhstan "On Technical Regulation" came into effect, which establishes the principles of technical regulation arising from the establishment, fulfillment of requirements for products, related processes, provision of services, and also defines the legal basis for the functioning of the state system of technical regulation.

To ensure this task, the Department of the Committee for Technical Regulation and Metrology of the Ministry of Technical Sciences of the Republic of Kazakhstan in the Karaganda region is authorized to conduct state control and supervision, which are divided into preventive control and supervision without a visit, preventive control and supervision with a visit, as well as unscheduled inspections of products, with the exception of products subject to state sanitary-epidemiological, veterinary-sanitary, quarantine-phytosanitary control and supervision.

It is important to note that on the territory of the Republic of Kazakhstan, it is prohibited to put into circulation products for which technical regulations have been put into effect, which have not passed conformity assessment, as well as without the availability of conformity assessment documents or in the absence of information about the availability of such documents in the register of technical regulation or unified registers of issued or accepted conformity assessment documents of the Eurasian Economic Union.

In the second half of 2021, the Department carried out 46 preventive control and supervision without visiting the following types of products: cable products, fire-fighting valves, fuels and lubricants.

For violating the requirements of the Technical Regulations "Product Labeling Requirements", approved by the Order of the Minister of Trade and Integration of the Republic of Kazakhstan dated May 21, 2021 No. 348-NK, 3 subjects were brought to administrative responsibility under paragraph 1 of Part 1 of Article 415 of the Code of the Republic of Kazakhstan "On Administrative Offenses" in the form of a fine totaling 1,137,630 tenge.
